way companies, within six months after the ascertainment of
the fact that, the estimated cost of the under grade crossing
exceeds the sum of twenty thousand dollars ($20, 000), and that
neither the said County Commissioners nor the said railway
companies are willing to pay the cost of said work in excess
of said sum of twenty thousand dollars ($20, 000), to place
gates at said grade crossings, one of said gates to be located
to the east of the right of way of the Maryland Electric Rail-
ways Company and the other of said gates to be located to the
west of the right of way of the Washington, Baltimore and
Annapolis Electric Railway Company and also maintain a
watchman day and night at said grade crossings, the cost of
the construction of said gates and the maintenance thereof of a
watchman to be paid and borne equally by said railway com-
panics.
SEC. 2. And be it further enacted, That the said railroad
companies shall pay and bear equally the expenses of the
said commission hereby created, which shall not, including
the compensation to the members thereof and to any per-
sons employed by it, exceed the sum of one thousand ($1, 000)
dollars. In the event that the said Shellman B. Brown, or
his successor, dies, resigns, fails or refuses to act as a
member of the said commission, the said Maryland Elec-
tric Railways Company shall appoint a member of the
said Commission in place of the said Brown. In the
event the said John N. Shanahan or his successor dies, resigns,
fails or refuses to act as a member of the said commission, the
said Washington, Baltimore and Annapolis Electric Railway
Company shall appoint a member of the said commission in
place of the said Shanahan. In the event that the said Seth
H. Linthicum or his successor dies, resigns, fails or refuses to
act as a member of the said commission, the Governor of the
State, upon the request in writing of any member of the said
commission, shall appoint a person owning property and re-
siding in the said fifth election district of Anne Arundel
county as a member of the said commission in place of the said
Linthicum.
SEC. 3. And be it further enacted, That this Act shall take
effect from the date of its passage.
