diversion of the said public road to a point where, in the judg-
ment of the said commission, it may be conveniently carried
under both of said railways and connected with the present
public road and for the construction of the section of said
road so diverted and of an undergrade crossing structure at
said point for such public road as diverted, and showing and
defining the length, width and course of the section of said
public road so to be diverted, the materials of which the same is
to be constructed and the method of constructing same and also
the design, height, clearance and other dimensions of said
undergrade crossing structure, the method of constructing the
same and the character, qualities and description of the mater-
ials to be used therein. The said commission shall also, with
said plans and specifications, submit the estimated cost of
said proposed undergrade crossing structure, including the
cost of the construction of the section of the said public road
proposed to be diverted, but exclusive of the cost and expense
of acquiring the land necessary for said section of the said
public road so to be diverted. If said estimated cost sub-
mitted as aforesaid does not exceed the sum of twenty thousand
dollars ($20, 000) or if the railroad companies, or the County
Commissioners of Anne Arundel county, or either of them, are
willing to undertake in writing with the said commission to
pay the cost in excess of such sum, then the said commission
shall require the said County Commissioners of Anne Arundel
county to forthwith acquire the land necessary for said section
of diverted road, furnishing to the said County Commissioners
a plat and description of the said land necessary for said sec-
tion of diverted road, and the County Commissioners are hereby
authorized, directed and empowered to thereupon acquire said
land by purchase or condemnation proceedings, said condemna-
tion proceedings to be instituted and prosecuted in the manner
provided for like proceedings instituted and prosecuted for
the condemnation of lands needed for the opening of new public
roads in Anne Arundel county. The cost and expense of
acquiring said land, including the cost and expense of said con-
demnation proceedings, if taken, shall be borne and paid by the
said County Commissioners of Anne Arundel county, not to
exceed in cost to them of one thousand dollars, without their
consent. Upon the acquisition of said land, as aforesaid, the
commission hereby created shall require the said railway com-
panies to immediately proceed to construct or cause to be con-
structed the said section of said diverted road and the under
grade crossing structure in accordance with the plans and
specifications submitted by said -commission as aforesaid, and
the said railway companies shall, in accordance with the said
