distance greater than five miles. Where prisoners or others are
conveyed to said institutions on the railroads the County Com-
missioners shall pay the constable or other officer the actual
railroad fare of the person so conveyed, and also the railroad
fare for the officers thus conveying them. This Act not to
interfere with the provisions of the law now existing in regard
to the fees allowed the sheriff of Anne Arundel county for such
service.

SEC. 2. And be it enacted, That this Act shall take effect
from the date of its passage.

CHAPTER 137.

AN ACT to create a commission of five persons to investigate
conditions and devise plans to safeguard the public using the
grade crossings over the railways of the Maryland Electric
Railways Company and the Washington, Baltimore and An-
napolis Electric Railway Company at or near Pumphrey
station, in Anne Arundel county, and authorizing said com-
mission to require said railway companies either to provide
safety gates and a watchman at said grade crossings or to
construct an under grade crossing structure at a point and
in a manner to be designated by said commission and by
means thereof to carry thereunder the public road to be
directed and constructed for that purpose, and empowering
and directing the County Commissioners of Anne Arundel
county to acquire by condemnation or otherwise land neces-
sary for said public road, if diverted, and defining the duties
and powers of said commission and providing for the cost
of the work and land and the expenses of said commission.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That the president of the Board of County Commissioners
of Anne Arundel county, the Chief Engineer of the State High-
ways Commission, Seth H. Linthicum, Esq., Shellman B.
Brown, Esq., and John N. Shanahan, Esq., be and they are
hereby created a commission (to be known as the Pumphrey
Grade Crossing Commission) to investigate the conditions sur-
rounding the grade crossings made by the intersection of the
Annapolis or Old Telegraph road with the lines of railway of
the Maryland Electric Railway Company and the Washington,
Baltimore and Annapolis Electric Railway Company at or near
Pumphrey station, in the fifth election district of Anne Arundel
county, and the said commission is hereby authorized and
directed to prepare and submit plans and specifications for the
