PRIVATE ACTS. 1353

folio 336, conveying two roods, two square perches and thirty
square yards of land. To a deed from Carson Ward and wife
and others, of date the seventh day of September, in the year
nineteen hundred and four, and of record in Liber No. 180,
folio 51, conveying one hundred and thirty-two square perches
of land. To a deed from Carson Ward and wife and others, of
date the thirty-first day of March, in the year nineteen hundred
and five, and of record in Liber No. 182, folio 40, conveying ten
thousand seven hundred and sixty-one square feet of land. To
a deed from Nathen J. Walker and others, trustees, of date
the twenty-first day of March, in the year nineteen hundred and
six, conveying one and one-tenth acres of land. To a deed from
Nathen J. Walker and others, trustees, of date the twenty-
eighth day of February, in the year nineteen hundred and
eight, conveying one-half acre of land. All of said land lying
and being in the town of Gaithersburg, in said Montgomery
county, in the State of Maryland, and all references being
to the Land Records of said Montgomery county, in the State
of Maryland.

SEC. 2. And be it enacted, That said corporation be and it
is hereby empowered and authorized to hold the said lands in
fee simple, with full power to sell, dispose of, mortgage or
lease the same or any part of the same.

SEC. 3. And be it enacted, That this Act shall take effect
from the date of its passage.

CHAPTER 657.

AN ACT to refund to Frederick Gas and Electric Company a

sum of money erroneously paid by it into the State Treasury.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That the Comptroller of the Treasury be and he is hereby
authorized and directed to issue his warrant upon the Treas-
urer of this State in favor of Frederick Gas and Electric Com-
pany for the sum of four hundred and forty-five (445.23) dol-
lars and twenty-three cents, being the amount of money for
the gross recipts tax due by the Isabella Gas Company of Fred-
erick, Maryland, for the years 1898, 1899 and 1900, erro-
neously paid into the State Treasury by said Frederick Gas
and Electric Company, the repayment of said sum of money to
said company having received the recommendation of the State
officials.

SEC. 2. And be it enacted, That this Act shall take effect
from the date of its passage.
