not less than ten days' notice thereof in one or more newspapers
published in the town of Easton, or by hand bill, or both. If the
Mayor elect or any member elect of the Council shall fail to take
the oath prescribed, on or before the second regular meeting
after his election, such failure may be deemed a refusal to act;
and if the Mayor or any member of the Council shall remove
from the town, or from any cause become permanently inca-
pacitated to act as such officer, such removal or permanent
incapacity shall create a vacancy.

SEC. 2. And be it enacted, That this Act shall take effect
from the date of its passage.

CHAPTER 440.

AN ACT to amend chapter 458 of the laws of Maryland, passed
by the General Assembly of Maryland at the January session
of 1906, by adding to article 21 of the Public Local Laws of
Maryland, title "Talbot County." sub-title "Easton," two
sections to be designated section 7AA and section 97BB, pro-
viding for the appointment of Commissioners for the town
of, Easton in certain cases.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That the following sections, to be designated section 97AA
and section 97BB, to be added to article 21 of the Code of Pub-
lic Local Laws of Maryland, title "Talbot County," sub-title
"Easton," as passed by the General Assembly of Maryland at
the January session of 1906.

97AA. Whenever the Mayor and Council of Easton shall de-
termine to reconstruct the streets of the town of Easton, or
to purchase or erect any gas plant, electric light, heat and
power plant, water plant or system of sewers for the town
and having submitted the proposition or propositions to the
legally qualified voters of the town at a regular or special elec-
tion, and a majority of said voters who vote for and against
the proposition have approved the same, then the Mayor is
authorized and empowered to appoint, by and with the consent
of the Council, four of the legal voters and freeholders of the
town, not office holders, who, together with the Mayor, shall
constitute a Commission, which shall have charge of the con-
struction of such improvement and shall have power to adver-
tise for bids to do all or any part of the work and to furnish
material; to make contracts for doing all or any part of the
work or for furnishing material; to appoint such assistants as
