mittee by the death, resignation or declining to
act of any member thereof, the directors of the
Mountain Lake Park Association, of Garrett
county, may fill the vacancy.
SEC. 5. And be it enacted, That at said an-

nual meeting, or regular adjournment thereof, a
rate of assessment shall be annually fixed agree-
ably to the fair valuation of the different lots
and improvements thereon., said assessment to
be collected and enforced in the manner herein-
after set forth.
SEC. 6. And be it enacted, That it shall be
the duty of the said annual committee of the

Community of Mountain Lake Park to collect
and enforce the payment of the annual assess-
ment aforesaid, in the manner hereinafter set
forth, and to hold the proceeds of such collec-
tions, with the proceeds of any annual subscrip-
tions, or other moneys or funds of the said com-
munity of Mountain Lake Park, as the common
fund of said community, and discreetly and pru-
dently to expend and lay out the same for
the expressed purposes for which said com-
munity is incorporated, and no other ; but
said annual meeting shall have the right to
make all necessary by-laws and regulations and
to appropriate said funds, and to instruct the
said annual committee of the Community of
Mountain Lake Park as to such expenditure or

laying out, which instruction shall be abso-
lutely binding upon said annual commttee ; pro-
vided, always, that it be for the express pur-
poses for which said community is incorporated,
and no other; and provided further, that nothing
herein contained shall be construed to take away
from the corporation of the Mountain Lake Park
Association, of Garrett county, its exclusive use,
possession, property and control of its auditor-
ium grounds and buildings, and all its own prop-
erty, whether improved or unimproved, not sold
or leased by it or conveyed to others.

SEC. 7. And be it enacted, That it shall be the

of Mountain Lake Park, at some convenient
