FRANK BROWN, ESQUIRE, GOVERNOR.

showing the extent to which the turnpike will be affected
thereby, which shall be filed with the application for the con-
demnation; provided, that in the location of such tracks on
said turnpike, a double track shall be constructed in the center
thereof from the intersection of Lombard street and the
Frederick road to London Park Cemetery, the rails thereof to
be tram girder rails, and said turnpike, between last mentioned
points, to be paved between the said tracks and for two feet
outside of the same, and to be kept in repair by said company;
and from said cemetery to a point opposite the residence of
Dr. Macgill, in the village of Catonsville, a single track along
the side of the said turnpike as now located may be laid, and from
said point opposite the residence of Dr. Macgill, to the pres-
ent terminus of the horse railroad as now located in the vil-
lage of Catonsville, a single or double track shall be laid with
tram girder rails in the center of said turnpike, between said
last mentioned two points, and a pavement as above provided
for shall be laid between the rails, and for two feet on either
side thereof, to be kept in repair by said railroad company.
And it is further provided, that where a single track is used,
the necessary turn-outs and switches may be also laid.
Between the terminus of the road in Baltimore city, and said
cemetery, and between Dr. Macgill's house and the terminus
at Catonsville, span wire construction shall be adopted, and
between London Park Cemetery and Dr. Macgill's house,
centre pole or bracket construction shall be adopted, said wires
to be strung on poles not less than sixteen feet high. And
provided further, that all changes of grades as now existing
within the limits of Baltimore county, shall be done under the
supervision, and subject to the approval of the County Com-
missioners of Baltimore county; and that they shall exercise a
supervision over the work.

SEC. 2. Be it further enacted, That in the event that the said
Baltimore, Catonsville and Ellicott's Mills Passenger Railway
Company, a street railway corporation, formed by the consolida-
tion of the Baltimore Union Passenger Railway Company, the
Baltimore and Hampden Passenger Railway Company and the
Highlandtown and Point Breeze Railway Company of Balti-
more, and the successor of the property, rights and franchises
of said corporation, the said new corporation so formed shall
be vested with all the grants vested in the first section of this
act, and may exercise the same and operate the railways of the
said Baltimore, Catonsville and Ellicott's Mills Passenger Rail-
road Company, in connection with its railway tracks in Balti-
