LAWS OF MARYLAND.

tricity.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That the Baltimore, Catonsville and Ellicott s
Mills Passenger Railroad Company, be and it is authorized and
empowered to use electricity as a motive power on its railway
between Baltimore city and Catonsville and upon an extension
thereof to Ellicott City, from its present terminus along the
west side and over Beaumont avenue to Benzinger's lane; and
from thence to Ellicott City, on an extension of said Beaumont
avenue as now in progress of opening under the supervision
and subject to the approval of the County Commissioners of
Baltimore county, where said road runs over a county as public
road; and to construct and operate double passenger railway
tracks on the turnpike of the President, Managers and Company
of the Baltimore and Fredericktown Turnpike Road, with
power also to alter the grade thereof; and to change the location
of its tracks as now placed thereon, upon, such terms and condi-
tions as may be agreed upon between said Baltimore, Catons-
ville and Ellicott's Mills Railroad Company and the President,
Managers and Company of the Baltimore and Fredericktown
Turnpike Road, which contract in respect to said matters the
said turnpike company is authorized and empowered to make;
should said companies fail to agree upon the terms and condi-
tions for the use hereinbefore mentioned, then the said passen-
ger railroad company shall be, and it is empowered to acquire
the easement and estate in said turnpike necessary for the exer-

cise of the rights hereinbefore mentioned, by condemnation
proceedings under the two hundred and forty-eighth, and the
following sections of article 23, Code of Public General Laws,
sub-title "Condemnation of Property by Corporations ;" pro-
vided, the application for the issue of the warrants as provided
by said sections, may include the entire interest, easement and
estate required, situated in both Baltimore city and Baltimore
county, and said application, including such location in both
city and county, may be made to any judge of the Circuit
Court for Baltimore county, and the jury summoned from said
county shall justly and impartially value the damages which
the President, Managers and Company of the Baltimore and
Fredericktown Turnpike Road will sustain by reason of the
occupation in the manner hereinbefore provided, of their
turnpike in both city and county, and the sheriff summoning
the jury shall give ten days' notice to the said turnpike com-
pany of the time and place of the meeting of the jury sum-
moned as aforesaid; and the said railroad company shall
exhibit to the jury at the time of said condemnation, a profile
showing any proposed changes of grade, with cross sections
