the seals of the respective companies, and filed with the Secre-
tary of State, shall be evidence of such consolidation and of
the existence of the consolidated corporation so formed; pro-
vided, however, that upon making.such consolidation a stock-
holder of any company consolidating with the Columbia and
Maryland Railway as aforesaid, voting against said consolida-
tion, or declining to assent to the same, shall be paid by the
consolidated company the actual market value of the stock held
by him of the companies so consolidated under the provisions
aforesaid; and if the parties cannot agree upon the value of
the said stock, the same shall be submitted to arbitration, one
arbiter to be appointed by each of the parties, and the two so
appointed to choose a third, and if they fail to agree upon the
third arbiter, the Circuit Court of Baltimore city shall, upon
application of either party, appoint such third arbiter, and the
decisions of the majority of the arbitrators so chosen shall be
final and conclusive upon both parties.

SEC. 2. And be it further enacted, That the said Columbia
and Maryland Railway, its successors and assigns, are hereby
empowered to endorse or guarantee any evidences or indebted-
ness of any passenger railway company, or to purchase such
other railways, or to subscribe or purchase the stock, bonds or
other evidences of debt of any company which may own or
operate a passenger railway.

SEC. 3. And be it enacted, That this act shall take effect
from the date of its passage.

CHAPTER 339.
AN ACT to empower the County Commissioners of Calvert
County, to levy a sum of money for the building of a school
house for white children in Election District number two, at
or near Prince Fredericktown, in Calvert County.

SECTION 1. Be it enacted by the General Assembly of Mary -
land, That the County Commissioners of Calvert county, may,
in their discretion, levy for the building of a school house, for
white children, in Election district number two, at or near
Prince Fredericktown in Calvert county, such a sum of money
as may be deemed sufficient, not to exceed four hundred dol-
lars.
