CHAP. 42.

hundred and twenty-nine, each subscribe for five hundred
shares amounting to the sum of ten thousand dollars for each
bank in the stock of the Frederick and Harpersferry Turnpike
Road Company, or in the stock of the company incorporated
to make a turnpike roacl from the District of Columbia through
Montgomery and Frederick counties to Fredericktown, or in
the stock of the company incor ported to make a turnpike road
from the town of Westminster, in Frederick county, through
Harman's Gap to Hagerstown, in Washington county, or in
the stock of the company incorporated to make a road from
the turnpike near Westminster to Taneytown, thence with the

main street through Emmitsburg to Troups tavern.
SEC. 2, And be it enacted, That said hanks or such of them-
as shall accede to the terms of this act, be and they are here-
by authorised to contract with the President and Managers of
the said roads, or of either of them, for the construction of a
proportion of such road or roads and bridge or bridges neces-
sary for the same, and to apply the amount of their subscrip-
tion or subscriptions, as the case may be thereto, which said
part of such road or roads, and said bridge or bridges upon the
completion thereof, shall be, and become the property of said
bank or banks, contracting for the same in like manner, as the
same is authorised to be held, used and enjoyed by the said
companies, or either of them.

SEC. 3. And be it enacted, That the extension of the char-
ters herein brfore provided for, shall be secured to the banks
aforesaid, or any or either of them, complying with the terms
of this act, without any dependance on the refusal or delay of
the others, or of either or of any of them.

Certificate of sub-
scription

SEC. 4 And be it enacted, That upon the said banks or any
of them, subscribing ten thousand dollars each in the stock of
either of said roads, it shall be the duty of the president of
each bank so subscribing, to obtain and transmit to the exe-
cutive of this state, a certificate of such subscription, whereup-
on the charter of such bank or banks so subscribing, shall be

deemed to be extended as aforesaid; provided, nevertheless,
that it the said banks, or either of them shall determine to
take their respective amounts of stock in the said roacl lead-
ing from Georgetown to Fredericktown, then their charters
shall not be extended as aforesaid, unless the said road is
completed from Fredericktown to the Monococy, and a bridge
over the Monococy is also completed by the whole amount of
stock taken by said banks, and such individual subscriptions
as may be made — and provided also, that if the said banks, or
cither of them, shall determine to take their said respective
amounts of stock, in the said Frederick and Harper's Ferry
turnpike road, then their charters shall not be extended as
aforesaid, unless the said road is completed as far as the Ca-
toctin Creek, together with a bridge over said creek, with the
funds subscribed by said banks, and such individuals as may
also subscribe,
