SEC 5. And whereas, the act entitled an act, incorporating
a company to make a turnpike road from the city of Frede-
rick to Harper's ferry has expired by its own limitation on the
fourth day of February, eighteen hundred and twenty -seven,
and the proceedings thereunder had annulled and, avoided.
Therefore, Be it enacted. That the said ac t be, and the same
is hereby revived and continued, except the nineteenth section
thereof, which is hereby repealed; provided, nevertheless,
that the subscriptions heretofore made under said act, shall
not be obligatory on the parties thereto, unless their assent in
writing be given thereto, upon the re-opening of the books of
subscription by the commissioners in the said act named,

agreeably to the provisions thereof.
SEC. 6. And be it enacted, That so soon as one thousand
scares of the stock of said Frederick, and Harper's Ferry
Turnpike Road Company shall be subscribed, it shall be the
duty of the Frederick commissioners to procerd in carrying
said act into effect, in the ma iner provided by the said original
act, and as if the whole amount of stock contemplated by said
act had been subscribed; and the said company shall be au-
thorised to collect upon the road, which they may construct,
tolls proportionate to the extent of road constructed.

SEC. 7. And be it enacted, That the commissioners named
in the supplement to the act entitled "an act to incorporate a
company to make a turnpike road from the line of the District
of Columbia, where it crosses the post road leading from
Georgetown to Fredericktown, through Montgomery and
Frederick counties to Fredericktown, passed at November
session, eighteen hundred and twelve, or the survivors of
them, or a majority of such survivors as shall act under this
law, shall, and they are hereby authorised to open books, and
receive subscriptions for atock, (and on the terms and notice,
except that the notice to be given, shall be sufficient if pub-
lished in one newspaper printed in the District cf Columbia,
and one printed in Frederick and one in Rockville,) and in
the manner provided for by the said act, and upon the sub-
scription of one thousand shares, to organise said company,
and when organised, the said company shall be authorised to
commence said read from such points as may be, deemed ex-
pedient, and upon the completion of the said road or any part
thereof, to collect proportionate tolls.

SEC. 8, And whereas it is represented to the General Assem-
bly, Tnat the erection of a bridge across Monococy, on the
route contemplated by said act, would greatly promote the
public convenience; therefore, be it enacted, that the said
company be, and they are hereby authorised to construct a
bridge over the Monococy at such point of said river, as may
be deemed expedient, and to collect a toll thereupon, to be
proportioned to the cost thereof, in relation to the cost of said
road, as is hereinafter provided.
