of the same twice a week for two successive weeks in at least
two of the daily papers published in the city of Baltimore.
SEC. 5, And be it enacted, That the sums assessed upon
the property benefitted shall be lien upon the same, and shall
be collected by the city collector, who shall be allowed there-
for a commission of five per centum upon the amount collected
by him, and shall be by him paid over to the mayor and city
council of Baltimore, and by them to the persons entitled to
receive the same, the said collector shall give twenty days
notice of the time of payment in two of the newspapers print-
ed in the city of Baltimore, which time shall be within thirty
days after the return of the proceedings of the said commis-
sioners; and should any sum or sums assessed as aforesaid,
not be paid within that time, the collector is hereby authorised
and directed to sell the property or any part thereof , on which
such assessment shall have been laid, giving not less than
twenty days notice of such intended sale, in two of said news-
papers, and the collector on receiving the purchase money on
said sales shall.execute to the purchaser 6r purchasers, a deed
or deeds of conveyance for the property that, may be so sold,
which deed or deeds shall pass to the purchaser or purchas-
ers, and his or their heirs all the estate and interest of the
person or persons assessed, and neglecting to pay as aforesaid,
in and to such property, and after deducting the expenses of
sale and advertising, the collector shall pay over the balance
to the mayor and city council aforesaid, who shall pay over
said balance, after deducting therefrom the amount assessed
on said oroperty, to person or persons entitled thereto, on de-

mand,without interest; Provided, nevertheless, That any person
considering himself or herself assessed in too large amount,
may in proper person or by attorney appeal to Baltimore coun-
ty court, upon petition filed within thirty days after the first
publication of the return by the register, which said court shall
have power to affirm, reverse or modify the assessment of the
commissioners, and the decision of which said court shall be

given without delay, and shall be final and conclusive; And
provided also , That any sale made under this section shall be
nail and void, if the owner or owners at the time being, or
his or their heirs or representatives shall at any time within
five years, tender to the purchaser the principal, interest, costs
of deed, and amount of taxes that may have been paid by said
purchaser.

SEC. 6. And be h enacted, That each of the said commis-
sioners shall, on or before the first day of April next, take the
following oath or affirmation; I, A, B, do solemnly swear or
affirm, that I will forthwith, and to the best of my ability exe-
cute the duties assigned me by the act, entitled, An act for
the widening of Orange alley in the city of Baltimore, with-
out favor or partiality, and if any of the said commissioners do
not on or before the first day of April next, take said oath or
affirmation, he shall be considered as having resigned, and it
shall be the duty in such case, of the said commissioners here-
in before named as may have qualified, forthwith to appoint
another or other commissioners as the case may be,
