such a thing as a school fund derived from special

taxation or from endowments of various sorts, and our

investigation indicates that Maryland has none of any

consequence and that this Section 3 is referring to

some anachronism.

We recommended that it be eliminated for

that reason and not because we wanted to see the

appropriations for use of the schools violated and --

though amounts are appropriated to agencies, this act

of the legislature creates no funds in the State but

at a test case in saying that the legislature could nc
