468 LAWS OF MARYLAND. [CH. 258

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Sections 49 and 50 of Article 11 of the
Code of Public Local Laws of Maryland (1930 Edition),
title "Frederick County, " sub-title "Brunswick, " sub-head-
ing "Water Works, " be and they are hereby repealed and
re-enacted with amendments to read as follows:

49. The said Mayor and Council of Brunswick are here-
by authorized to agree for the purchase, lease and rental
with the owners of any real estate, right of way, easement,
water right, spring, brook, water or water courses as afore-
said, earth, timber, stone, or other material which they may
deem expedient or necessary to purchase or hold, for the
purpose of introducing an additional supply of water into
or improving the present supply of water in the town of
Brunswick.

That if the said Mayor and Council cannot agree with or
if there be any incapacity or disability to contract on the
part of the owner or owners of any real estate, right of
way, easement, spring, brook, water or water course, earth,
timber, stone or other material, which they may find it
necessary to have, or through or over which a right of way
or entry or passage is desired for the purpose of carrying
the said water into or through the said town; or if such
owner or, owners shall be absent, out of the State or un-
known, it shall be lawful for the Mayor and Council of
Brunswick to acquire by condemnation any such real estate,
right of way, easement, water right, spring, brook, water
or water course, franchise, earth, timber, stone or other
materials which they may deem necessary, in the same
manner and by the same proceedings as now provided in
condemnations by corporations, under Chapter 117 of the
Acts of the General Assembly of 1912.

50. The said Mayor and Council shall have and are
hereby invested with full power and authority to enact and
pass all ordinances which from time to time they may deem
necessary and proper to execute the objects herein specified
and to regulate the introduction, management, protection,
use of and examination of the water works, the water sup-
ply of said municipal corporation, and for the protection
and preservation of its works, machineries, all service and
distribution pipes, hydrants and improvements connected
therewith; to fix and establish rates or charges for the use
of the water, and for collecting and enforcing payment of
said water rents and charges, and which rents and charges
as well as all or any other monies received by the Mayor
