Bailiff and such number of under Bailiffs as they may, at any
time, deem necessary to properly preserve the peace, and a
Treasurer, whose duties and qualifications shall be herein-
after prescribed.

1035. The Mayor shall preside at all meetings of the Coun-
cil, and at all town meetings, unless prevented by sickness or
reasonable cause, in which event the said Council shall select
a President pro tempore; he shall sign all by-laws and ordi-
nances of said Council and shall countersign all orders and
drafts drawn by the Clerk, and under the direction of the said
Council on the Treasurer of said town.

1036. The Clerk shall be appointed from among the mem-
bers of the Town Council; he shall before entering on his duties
make oath before the said Council or any of them, that he will
well and faithfully perform the duties of his office as prescribed
by this Act, or which may be prescribed by any by-law or or-
dinance of said Council, to the best of his skill and judgment;
he shall sign all drafts or orders for money appropriated or
ordered by the Council to be paid by the Treasurer, and keep
a record of the proceedings of said Council in a book to be
provided by them for that purpose, which shall at all times be
open to the inspection of any qualified voter.

1037. The Bailiff shall be appointed from the inhabitants
of said town and qualified to vote for the Mayor and Town
Council; provided, however, that the said Council may ap-
point a constable or citizen of the election district in which
said town is located, if he be a resident of said town or will
reside therein or in close proximity thereto after his appoint-
ment; before entering upon the duties of his office he shall
make oath before a Justice of the Peace for Montgomery
County that he will faithfully and impartially perform the
duties imposed upon him, by the act of corporation and the
by-laws and ordinances of said Council, and shall execute to
the State of Maryland a bond obtained from an acceptable
bonding company with good and sufficient security to be ap-
proved by the said Town Council in such penalty as they shall
prescribe, conditioned that he shall well and faithfully per-
form the duties of said office in all things appertaining there-
to according to law and the ordinances of said Council, and
shall well and truly collect and pay over to the Treasurer of
said corporation all taxes and assessments levied by the
Council and all other sums of money that may be received
by him for the use of said corporation.

1038. The Treasurer shall be appointed from among the
members of the Town Council, and before entering upon the
