in this Act, an election may be held at any time after ten
days' notice thereof shall have been given by the Town Coun-
cil, or a majority of them, and in the event that a majority of
the said Council shall become disqualified to act, or shall have
failed, or shall fail to hold any election for the space of thirty
days from the second Saturday in September in any year,
then it shall be lawful for any three or more qualified voters
of said town to give notice, either by written or printed hand-
bills, or by publication in some newspaper published in Mont-
gomery County, Maryland, of an election to be held on a cer-
tain date, at least ten days from the date of publication or
posting of such notice for Mayor and Town Council under
this Act, and a majority of voters present at the hour fixed
by said notice for the commencement of said election shall
select three judges to hold said election.
1030. If at any election held under this Act two or more
persons shall receive the same number of votes, the judges
of said election shall, after having given five days' notice of
the time and place, proceed to hold another election to fill
up the vacancies, and the person or persons receiving the high-
est number of votes at said election shall, with those pre-
viously chosen, if any, constitute the Mayor and Town Council
of Washington Grove.
1031. If any vacancy shall occur by death, resignation, re-
moval or failure to act of one or more of the Mayor and Town
Council elected as aforesaid, the remaining members of the
Town Council, or a majority of them, shall elect a proper
person to fill the vacancy until the next annual election, when
the vacancy shall be filled by ballot to fill the unexpired term.
1032. Every Councilman and the Mayor, before he pro-
ceeds to act as such, shall make oath before some justice of the
peace or notary public for Montgomery County that he will
diligently and faithfully, according to the best of his skill and
judgment, perform his duties without favor, partiality or
prejudice, and a certificate of such qualification shall be re-
turned by the said justice of the peace to the Town Council to
be filed and recorded among the proceedings.
1033. The said Mayor and Town Council shall meet at such
place as they may appoint within said town, on the second
Monday of every month ensuing their election, and as much
oftener by adjournment as they shall deem necessary, or on
call of the Mayor.
1034. The said Town Council shall annually appoint a
Clerk, who shall keep a list of all qualified voters; a chief
