1410A. For the purpose of promoting the health, morals,
general welfare and security of the inhabitants of the Town
of Upper Marlboro, the Town Commissioners of Upper Harl-
boro are hereby empowered to regulate by zoning ordinances
the use, location, height, bulk and size of buildings and other
structures, building lines minimum frontages, depths and
areas of lots, percentage of lots that may be occupied, size of
lots, the use of open spaces, the location of temporary stands
and structures, billboards and other forms of outdoor adver-
tising, the density of population and the use of buildings
and/or land for trade, industry, residential or other purposes.
The Town Commissioners may institute any appropriate ac-
tion or proceeding to prevent the erection use or maintenance
of any structure, building or land in violation of any ordi-
nance passed hereunder.
1410B. The wilful violation or refusal to act under any ordi-
nance passed by the Town Council under the powers granted
by Section 1040A of this sub-title is hereby declared to be a
misdemeanor punishable by a fine not to exceed $100.00 or
imprisonment not to exceed 90 days, or both fine and im-
prisonment.
1410C. The Town Commissioners of Upper Marlboro in ad-
dition to the powers now granted to them shall have the power
to acquire by purchase or by condemnation under the pro-
visions of Article 33A of the Annotated Code of Maryland
(1930 Edition) any private property that in their judgment
may be needed for municipal purposes, whether the same lies
within the limits of said Town or outside thereof and they
shall have full power to authorize the sale or disposition of
any property including surplus water owned or acquired by
the Town whenever in their judgment it is advisable and for
the best interest of the Town that the same shall be sold or
disposed of.
SEC. 2. And be it further enacted, That this Act shall
be submitted for adoption or rejection to the qualified
voters of Upper Marlboro at a special election to be held on
the 1st Monday in June, 1947. There shall be printed on the
ballots to be used at said election the title of this Act and
underneath said title on separate lines a square or box to the
right of and opposite the words "For Zoning Act," and a cor-
responding square or box to the right of and opposite the
words "Against Zoning Act," so that the voters shall be able
to designate by a cross-mark in the proper square or box their
decision for or against said question. If a majority of the
votes cast on said question shall be "For Zoning Act," then
