assignes and every of them that hee and they Shall & may for Ever hereafter quietly & peaceable have
hold occupy possess and Injoy the Said Land & pr:misses with the & every y appurtenances without
the Lett Sute trouble Deniall disturbance molestation Interruption of us the Said Thomas Oxford and
Susanna his wife or of either of us our estates rights or Titles And it is further hereby declared and
Concluded by and betweene all the parties to these presents That the Said Land Called old Berre
& premisses together with all & every the hereditamts: & appurtenances Shall for ever be remane &
enure to y only proper use & behoofe of the Sd: William Hearne his heires & assignes & to noe other
use intent or purpose whatsoever Wittnes whereof the Said Thomas Oxford hath hereunto Set
his hand & fixed his Seale in presence of the Wittnesses whose names are herewith Subscribed

Memorandum That this day to witt the 7th: day of Aprill in the Third year of the Reigne of our Sovereign
Lord James the Second of England Scotland ffrance & Ireland defendrs: of the faith &c And in the xiith year
of the Dominion of the Rt: honr:ble Charles absolute Lord & Propietary of the Province of Maryland &
Avalon Lord Baron of Baltemore &c Annoq: Dom: 1688 before us James Round & Samuell Hopkins Two of
his Lopps Justices of y peace Came Thomas Oxford & Susanna his wife parties to this within written
Indenture in theire proper persons & the Said Susanna being by us alone & Secretly examined according
to the forme of a Certaine Act of Assembly in that Case made & provided Did acknowledge the Sd: Land
Called old Berre in the Said within written Indenture mentioned to be the Right of the within named
William Hearne as those which the Said William hath of the guift of them y Said Thomas Oxford
& Susanna his wife they haveing graunted for theire heires & every the heires of the Said Susanna
that the Said land within mentioned unto him the said William Herne & his heires & assignes -
agt: them the Said Thomas Oxford & Susanna & theire heires and all & every the heires of the Said
Susanna they will warrant for Ever & for this acknowledgement quit Claime & agreement
the Said William Hearne having given unto them the Said Thomas Oxford & Susanna the
Sum of Three Thousand pound of Tobacco ~ ~ ~ ~ ~ ~ ~ ~ ~ ~

which may have or Shall Come to his hands possession or knowledge (appraysed in Money) and (a)
true & Just Accompt of and upon his administration therein And to exhibitt both into our County Court
