77 This Indenture made the ffourth day of Aprill in the third yeare of the Reign of our Soveraigne Lord James the Second by the grace of god King of England &c and in the thirteenth year of the Dominion of the Rt: honr:ble Charles over Maryland and Avalon Annoq Dom: 1688 Betweene Thomas Oxford and Susanna his wife of Somerset County & Province of Maryland planters of the one part And William Hearne of the Said County and Province of the other part Wittnesseth That whereas the Rt: honr:ble the Lord Pro prietary by his Deed of graunt under the great Seale of the Sd: Province bearing date at St:Maries the first day of June in the Tenth year of oure Dominion Annoq Dom: 1685 Did grante unto the Said Thomas Oxford ACertaine Tract or parcell of Land Called old Berry Scituate Lyeing & being on the east Side of Chesepiake bay in a river Called Pocomoke on the South east Side of y Sd: river about ffour miles back in the woods bounded as ffolloweth beginning at a marked white oake Standing Near Mattapeny Cart Road to Pocomoke river on the Southward Side of a parcell of Land Surveyed for Richard Peper Junr: thencewith a Line drawne South South west one hundred and Six perches to a marked white oake Standing by a branch thence Containing Same Course into the branch Twenty perches Thence with a Line drawne Southeast by South one hundred forty perches to a parcell of Land Surveyed for Tobias Peper to a marked white oake being a Corner tree of the Said Peper thence with a Line drawne east by South Two hundred and Twenty perches thence with a right Line ~ drawne to the first bounder Containing & now laid out for Two hundred acres more or Lesse according to Certificate Surver thereof taken & returned into the Land office at the Citty of St: Mariess bearing date y twenty Second of December one Thousand Six hundred Eighty three and there remaining upon record Together with all rights Proffitts bennefitts and Priviledges thereunto belonging royall mines excepted To have & To hold the Same to him the Said Thomas oxford his heires & assignes for ever undr: Such rents Covenants Servicess and Provisoes as in the Said graunt is mentioned & expressed recourse being there unto had it Doth more fully and more at Large appear now that I the Said Thomas Oxford & Susanna my wife for divers good Causes & valuable Consideracons us hereunto moveing but more espetially & perticularly for and in Consideration of Three Thousand pounds of Tobacco to us in hand paid by William Hearne aforesaid the receipt whereof wee doe by these Presents acknowledge and that thereby wee are fully Satisfied Contented and paid by And thereof & of every part & parcell thereof wee the Sd: Thomas Oxford & Susanna doe ~ hereby acquitt exonerate & discharge the Said William Hearne his hieres & assignes for Ever have given graunted bargained Sold feofed and Confermed And doe by these presents Doe give grant bargaine alliene Sell enfeofe Confirme unto him the Said William Hearne the Said Tract of land Called old Berry laid out butted & bounded as aforesaid Containing by measure Two hundred acres more or Lesse To have and to hold the Said Tract of land Together with all the Proffitts bennefitts and appurtenances thereunto belonging Royall mines excepted unto him the Sd: William Hearne his heires and assignes for Ever The Said himselfe his heires executors admrs: & assignes doth further Covenant yt the Sd: William Hearne now is and Standeth by force & virtue of these presents Lawfully & absolutely Seized of the Sd: Land Called old Berre & every y pr:misses without any Condition or Limitacon of all or any use or uses to alter Charge or determine or make vide y Same & that the Said Land Called old Berre with the and every of the appurtenances now are & Shall Soe for ever hereafter remaine Continue and be unto the Sd: William Hearne his heires and assignes free & freely Clear & Clearly acquitted exonerated and discharged of and from all & all manner of former & other guifts grants Leases Joyntures Dowries wills Annuities Intailes Statutes recognizances bonds execucons extent Seizures Condemnacons Rents arrearages of rents intrusions forfeitures Mortgages fines debts of Record tythes Troubles Charges & incumbrances whatsoever had made Committed done or Suffered by me the Sd: Thomas Oxford further the Said Thomas Oxford & Susanna his wife for themselves theire heires executors and assignes |
