35 mortgage redemption use of Limitation to recall allow Charge or determine the Same To be holden of the said Lord Propry. for and under the rents & Services by the original recited Deed of grant referred And the Said Henry Potter and Alce his wife The Said Two hundred acres of Land with the appurtenances before by these presents bargained and Sold unto him the Said Richard Brittain doe for ever acquitt & discharge the Same of and from all & all manner of former & other bargains and Sales forfeitures dowries Joyntures Surrenders and of and from all other Titles incumbrances Clames & demands of the Said Henry Potter and Alce his wife their heires or assignes And the Said Henry Potter and Alce his wife will warrant & defend & doth warrant the Sale of the Said Two hundred acres of Land to the said Richard Brittain his heires and assignes for ever Also the Said Henry Potter and Alce his wife for themselves their heires or assignes doth Covenant grant & promise from time to time all times duering the Space of five yeares next ensueing the date hereof at and upon the request and at the Cost & Charges in Law of the Said Richard Brittain his heires or assignes make doe performe acknowledge Suffer or Cause to be made done performed and acknowledged all & every Such further Lawfull & reasonable act and acts assurances and Conveyances in the Law for the better and more perfect Sure makeing and Conveying all & Singular the before hereby granted or hereby mentioned to be graunted premisses with their and every of their rights memb- & appurtenances to the onely proper use & behoofe of the Said Richard Brittaine and to the heires and assignes of the Said Richard Brittaine forever the Said Richard Brittaine his heires or assignes or his or their Councell learned in the Law Shall be devised advised or required In Confirmation and full assurance of the Truth above written the Said Henry Potter and Alce his wife hath to these presents Sett to their hands and fixed their Seales giving Deed & State with full & peaceable possession with by Livery of Seizin of and in the above mentioned premisses with y appurtenances thereunto belonging as the Said Henry Potter and Alce his wife fixeing their Seales and the Subscriptions as as testimo neys doe manifest the day and year Above written Signed Sealed & delivered Henry Potter (Sealed in the presents of us her William Coulbourne Alce A Potter (Sealed) Thomas Jones marke Memorandum That this day to witt the twenty Sixth day of March in the xiith year of the Dominion of the Rt:honr:ble Charles Annoq Dom: 1688 before us Collo: Wm: Coullbourne & Thomas Jones Two of his Lopps Justices of the Peace for Somr:sett County in the Province of Maryland Came Henry Potter and Alce his wife parties to this within written Indenture in their proper persons and the Said Alce being by us alone & Secretly examined according to y forme of a Certaine Act of Assembly in that Case made & provided did acknowledge the Said Two hundred acres of Land in the Said written Indentures mentioned to be the right of him the within named Richard Brittaine as those which the Said Richard hath of the guift of them the Said Henry Potter and Alce his wife and for themselves and theire heires have remised and made quit Claime thereof to the Said Richard Brittaine and to his heires for Ever And further the Said Henry Potter and Alce his wife and hath granted for themselves and their heires that the Said Two hundred acres of Land within mentioned unto him the Said Richard and his heires against them the Said Henry and Alce and their ~ heires and all and every the heires of the Said Alce will warrant forever and for this acknowledgemt: remise quite Claime & agreement the Said Richard hath given unto them the Said Henry and Alce five Thousand five hundred pounds of tobacco ffine recd: for the within mentioned Taken before us the day and year abovesaid Land according to Act of Assembly Wm: Coulbourne Wm: Brereton Sheriff Tho: Jones Intr: the Seaventh day of July in y Second year of their Maties Reigne William & Mary King & Queen of England &c And in the year of our Lord God one thousand Six hundred & Ninety & exa: word for word pr me Edm: Beauchamp Cler Cur This Indenture made the Tenth day of June in the year of our Lord God and with the Computation of the Church of England one Thousand Six hundred & ninety Betweene John ffrizell of Wiccocomoco in the County of Sommerset & Province of Maryland planter and Cullett his wife on the one part And William Wallis at the head of Rokawakin River in the County aforesaid planter on the other part Witnesseth That the Said John ffrizell & Cullett his wife for and in Consideration of the Sum of Eleaven Thousand pounds of good tobacco and Caske to them in hand paid at or before the ensealing & delivery hereof the receipt whereof they doe hereby acknowledge & of Every part & parcell thereof acquitt & discharge him the Said William Wallis And doe acknowledge |
