31 This Indenture made the Twenty fourth day of January in the xiiith: year of the Dominion of the Rt. honr:ble Charles absolute Lord & Propry: of the Province of Maryland & Avalon Lord Baron of Baltemore & in the year of our Lord God 1688 Betweene Donnick Dennis of Sommersett County in the Province of Maryland plantr: & Ellis his wife of the one part And John Outon of the County of Somr:Sett & Province of Maryland Sawyer of the other part Wittnesseth That whereas the Rt: honr:ble Cæcilias Lord Barron of Baltemore &c deceased by his Deed of grant undr: the great Seale used in the Said Province for Grannting of Lands bearing date at St: Maries the 23th: day of September in the xxxiiith: year of his Sd: Lopps: Dominion &c Annoge, Dom: 1665 Did for the Consideration therein mentioned graunt unto German Gillett all yt parcell of Land Called Ware Point lyeing on the eastearne Shore by a river there Called Pocomoke on the westerne Side of A Certaine Creeke Called Morumsco Creeke beginning at a marked oake Standing east at the Easterne pointe of A Marsh adjoyning to the Said Creeke & running along by the Said Marsh by a Line drawne South fifty perches for bredth to a marked pine Standing South thence running a Line west to a marked oake three hundred and Twenty perches for Length and Soe running North by a Line drawne from the end of the west line fifty & twenty perches Conteyning & now layd out for one hundred acres more or Lesse together with all rights Proffitts & bennefitts thereunto belonging (royall mines excepted) To have & to hold the Same to him the Said Jerman Gillett his heires and assignes for Ever undr: y rents & Conditions therein mentioned recourse unto the said Pattent being had it doth & may more fully & at Large appeare And whereas the Said Jerman Gillett & Sarah his wife Did by a deed or writing under their hands & Seales bearing date the 26th: day of March in the year of our Lord God 1667 for a valuable Consideration by them recd: grannt allienate bargaine Sell and Confirme unto the aforesaid Donick Dennis his heires and assignes all & Singular the above mentioned pr:misses with all rights proffitts & bennefitts thereunto belonging as in & by the Said recited deed or writing more fully and at Large recourse thereunto being had it doth & may appeare And ffurther whereas the Rt: Charles Lord Baron of Baltemore &c by his Deed of graunt undr: the great Seale used in the Sd:Province for granting of Lands there bearing date at the Citty of St: Maryes y Sixth day of May in the fourth year of his Loppt dominion &c Annog Dom 1679 Did for the Consideration therein mentioned graunt unto the aforesaid Donnick Dennis all yt Parcell of Land Called Webley lyeing on the east Side of the Chesepeak bay on the NorthSide of Pocomoke Bay in a Creek of the Said bay Called Morumsco bounded as ffolloweth beginning at a marked Small white oake ~ Standing on the north Side of a Small Hummock of woods on the westermost side of the said Creeke thence with a Line drawne east South east Sixty pearches thence with a Line drawne Southeast forty five perches to a Small Creeke in Marrishes thence with a line drawne northeast Eighteene perches thence with a Line drawne east Southeast one hundred Eighty Eight perches in Marrishes thence with a Line drawne North North West one hundred Seaventy Six perches thence with a Line drawne west Two hundred & fifty perches to a great Pine Stump on a point of land and from thence with a right Line drawne to the first bounder Conteining one hundred & fifty acres (more or Lesse) Together with all rights Proffitts & bennefitts thereunto belonging (Royall mines excepted) To have & to hold the Same unto him the Said Donnick Dennis his heires and assignes for Ever undr: Such ~ rents Services & Condicons as by the Said recited Deed recourse being thereunto had more fully and at ~ Large it doth and May appear Now This Indenture further witnesseth that the aforesaid Donnick Dennis & Ellis his wife for divers good Causes & Considerations as well as for the Consideraation of Twelve Thousand~ pounds of tobacco & Casque to them in hand paid by the aforementioned John Outon before the ensealing and delivery hereof whereof and wherewith the Said Donnick Dennis & Ellis his wife doth acknowledge themselves fully Satisfied & paid & thereof & Every part & parcell thereof doe Clearly & absolutely discharge the said Jno Outon his heires and assignes for Ever And by these presents have given grannted bargained and Sold & doe by these presents give grannt allienate enfeofe Confirme bargaine & Sell unto the Said John Outon his heires and assignes for Ever all them two parcells of Land aforementioned Called Ware point & Webley Together with all & Singular the y Proffitts Proviledges Pattents Indentures writings Comodities & hereditaments with all and Singular the houses Edifices orchards gardens ffences appurtenances Emoluments & easements thereunto |
