32 thereunto belonging or in any wise appertainingTo have and to hold the Said Two parcells of Land with all & Singular the premisses to him the said John Outon his heires and assignes for Ever To the only proper use & behoofe of him the said John Outon his heires and assignes for Ever without any Mortgage redemption af- Limitacon to recall after Charge or determine the Same To be holden of the Services as by the Said originall recited deedes of graunt is reserved And the Said Donnick Dennis and Ellis his wife the Said parcell of Land with all & Singular the premisses & appurtenances before by these presents bargained & Sold or hereby intended to be bargained & Sold unto him the Said John Outon doe for Ever acquit and discharge the Same of and from all and all manner of former and other bargaines grants Sales forfeitures Joyntures Dowries Surrenders and of and from all other Titles incumbrances Claimes and demands what soever of them the Said Donnick Dennis and Ellis his wife their heires executors or administrators & against all & every other person or persons whatsoever Lawfully Claimeing from by or under the Said Donnick Dennis & Ellis his wife Shall & will hereafter warrant & defend by these presents In Confirmation and full assurance truth above written giveing Deed and State with full & peaceable possession by Livery of Seizin of and in the mentioned pr:misses with the appurtenances thereunto belonging or appertaining as the sd: Donnick Dennis Ellis his wife theire Subscriptions & fixeing theire Seales & the witnesses Subscriptions as Testimonys doe ma- the day & year first above written ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ Signed Sealed & delivered in the the marke presence of us Thomas Newbold of Donnick X Dennis ( Seale Edmund Howard her Ellis O Dennis ( Seale marke Memorandum That this day to witt the Twenty fourth day of January in the xiiith:year of the dominion of the Rt: honr:ble Charles &c over Maryland Annoqe: Dom: 1688 before us Thomas Newbold and Edmund Howard Two of his Lopps: Justices for this County Came Donnick Dennis and Ellis his wife parties to this within written Indenture in theire proper persons & the Said Ellis being by the Said Justices alone & Secretly exa(mined) according to the forme of A Certaine Act of Assembly in that Case Made & provided) did acknowledge the Land in the within written Indenture mentioned & Called Ware point and Webley to be the right of him the within named John Outon as those which the Said John hath of the guift of them the Said Donnick Dennis & Ellis his wife & for them & their heires & the heires of the Said Ellis hath remised & made quit Claim thereof to the Said John Outon and his heires for Ever And further the Said Donnick Dennis & Ellis (his) wife have graunted for them & theire heires & all & Every the heires of the Said Ellis that the Said Land within mentioned unto him the said John Outon & his heires against them the said Donack Dennis (&) Ellis & their heires & all & Every the heires of the Said Ellis will warrant for Ever And for this Acknowledge quitt Claime & agreement the Said John Outon hath given them the Said Donnick Dennis & Ellis his wife Summe of Twelve Thousand pounds of Tobacco ~ ~ ~ ~ ~ ~ ~ ~ ~ Taken before us the day and yeare above Written Recd the fine of allienacon of the within mentioned Thomas Newbold Conveyance being 250 acres according to Act of assembly Edmund Howard Wm: Brereton Sheriff Intr: Primo July Annoge:Dom: 1690 pr me Edm: Beauchamp Cler Cur This Indenture made the Ninth day of June in the Second year of the Reigne of William & Mary of England King & Queene Scotland ffrance & Ireland^ defenders of the Prodestant Religion And in the year of our Lord God one Thousand Six hundred & Ninety Betweene John Emmitt & Hannah his wife of Somerset County in the Province Maryland of the one Part And John Miller resident in y Said County & Province of the other Part Witnesseth That wherease the Rt: honr:ble Charles Lord & Proprietary of the Province of Maryland & Avalon Lord Baron of Baltemore &c by his Deed of Graunt undr: the great Seale used in the Said Province of Mary(land) for granting of Land there bearing date at the Citty of St: Maryes the first day of June in the 12th:year of (the) Dominion &c Annoge: Dom: one Thousand Six hundred Eighty and Seaven for the Consideration there- |
