( 106 ) And Testament bearing date the twenty Seventh day of March in the year of our Lord One thousand Six hundred eighty and five, did give and bequeath unto his Execcutors in his said will named to be by them Sold towards the payment of his debts and Legacies, as by the said Will remaining upon Record in the Office for probat of Wills &ca in this Province, relation being thereunto had it doth and may appear at large. Now this Indenture Wittnesseth that the said James Cullen the Surviving Execcutor of the said Marke Cordea and in the sd will named for a valuable Consideration of fifteen hundred pounds of tobacco to him in hand paid by the said Nicholas ffountaine before the ensealing and delivery of these presents, the receit whereof the sd James Cullen, doth hereby acknowledge and to be therewith fully and clearly Satisfied and paid, and for every part and percel, doth hereby acquit and discharge the said Nicholas ffountain and his Heirs and Assigns. Doth hereby give grant bargain, Sell enfeoffe & Confirme unto the said Nicholas ffountain, and to his Heirs and Assigns for ever, all that the aforementioned tract or percell of Land Called now Rumney. Togeather with all and singular the rights and priveledges to the same belonging or any wayes appertaining. To have and to hold the said percell of Land and all and Singular the premises and appurtenances to the same in any wise appertaining or belonging unto him the sd Nicholas ffountain and to his Heirs and Assigns for ever to the only propper use and behoof of the said Nicholas = ffountain his Heirs and Assigns for ever. To be holden of the Chief Lord or Lords of the ffee thereof. under Such rents and Services & provisoes as are specified in the Originall Pattent or Deed granted for ye Same by the Lord Proprietery of this Province. And the said James Cullen the said percell of Land with the appurtenances before by these presents bargained and Sold unto him the said Nicholas: ffountain, doth for ever freely acquitt and discharge the same of and from all and all manner of other and former, grants bargains and Sails of him the said Marke Cordea. or his Execcutors or Assigns, shall and will for ever hereafter warrant and defend by these presents.
