                           CHAPTER 157.

AN ACT to authorise the Circuit Court for Carroll
     county to correct an error in the proceedings for the
     sale of the estate of Archibald Barnes and Sally Elizabeth
     Barnes.

5, 1853.
     WHEREAS, By a decree of Carroll county court, sitting
as a court of equity, Daniel Engle, of Carroll
county, was appointed trustee for the sale of the real
estate decreed to be sold by a decree passed in a cause
in said court, entitled the petition of Violette E. Barnes,
next friend of Archibald Barnes and Sally Elizabeth
Barnes, and designated on the equity docket of said
court as number one hundred and fifty-four; And
whereas,
in pursuance of said decree the said Daniel
Engle did sell and convey to the said Thomas Hood
the real estate in said cause mentioned by his deed dated
on the third day of May, in the year eighteen hundred
and fifty; And whereas, it has since been discovered
that there was an informality in said proceedings in,
that no commission was issued to view and ascertain
as required by the act of Assembly, whereby said
deed is supposed to be ineffectual, to give a good and
sufficient title to said land; And Whereas, it is represented
to this General Assembly that injury and wrong
would be done to the said Hood, unless relieved by
special act; Therefore,
Preamble.
     SECTION 1.  Be it enacted by the General Assembly
of Maryland,
That the deed above described, executed
by Daniel Engle, trustee, to Thomas Hood, bearing
date the third day of May in the year eighteen hundred
and fifty, be, and the same is hereby declared to
be as valid and effectual in law, as if a commission to
view and ascertain had been issued and legally executed
in the cause referred to in the preamble to this act:
Provided, the circuit court for Carroll county shall be
satisfied and so adjudge, upon affidavits or otherwise,
that the sale herein mentioned was at the time of said
sale for the interest and advantage of the infants, parties
to said proceedings.
Made valid.
     SEC. 2.  And be it enacted, That this act shall take
effect from the passage thereof.
