days from the day of the giving said notice: And should any
sum or sums of money so assessed and charged as aforesaid,
not be paid within the time so limited for the payment of the
same, the collector of the city of Baltimore shall be and he is
hereby authorised to sell at public sale for cash, the whole or
any part of the property on which such assessment shall be
made, first giving not less than thirty days notice of such intended
sale in one of the newspapers printed in the city of Baltimore:
And the collector of the city of Baltimore, upon the receiving
the purchase money for any part of the property so sold,
shall execute a deed or deeds of conveyance therefor, in favor
of the purchaser or purchasers, which deed shall be good and
sufficient to pass the fee simple estate in the said property,
and the collector of the city of Baltimore, aforesaid, after deducting
from the amount of such sale or sales, the amount assessed
and charged as aforesaid, upon the property so sold, the
cost of such sale or sales, the cost of advertising, and three per
cent. commission to himself, in addition tot he commission hereinafter
mentioned and allowed, shall pay over the balance to the
person or persons entitled thereto. |

4. And be it enacted, That each of
the members of the said
board of commissioners shall be allowed two dollars per day
for each day they are employed in the carrying into effect the
provisions of this law; and that the collector of the city of Baltimore
shall be allowed three per cent on all sums collected by
him under the provisions of this law; which per diem and commission
are to be considered as a part of the expense necessary
for the carrying of this law into execution, and are to be assessed
and levied as is herein before mentioned. |

5. And be it enacted, That the street
aforesaid shall not be altered
in the manner herein before mentioned, until the damages
by each person sustained and assessed as aforesaid shall be first
paid to the mayor and city council of Baltimore, for the use of
the person or persons entitled to receive the same. |

6. And be it enacted, That the act
entitled " An Act to widen
Water street, between South and South Calvert streets, in the
city of Baltimore," passed at December session, eighteen hundred
and twenty-four, chapter 152, be, and the same is hereby repealed. |

7. And be it enacted, That nothing
in this act contained, shall
be of any force or effect, until approved of by the mayor and city
council of Baltimore. |
