Baltimore, be, and they are hereby constituted a board of commissioners
to widen and extend Water-street, in the square between
South-street and South Calvert-street, to an equal width,
by removing the projection of the building known and distinguished
by the name of Cheapside Hotel, beyond the regular
south line of Water-street, in the said square; and whenever a
vacancy in the said board may occur by resignation, death, refusal
to act, or any other inability of either of the persons herein
named and appointed and authorized to act in conjunction
with the city commissioners aforesaid, or of any person or
persons appointed in the stead of them, or either of them, as is
hereinafter provided, that then the said board may supply
such vacancy by election, and a majority of the said board of
commissioners shall be competent to perform all the duties of
the said board. |

2. And be it enacted, That the aforesaid
board of commissioners,
or a majority of them, may at any time before the first day
August next, after having given at least ten days notice in one
of the newspapers printed in the city of Baltimore, and after
having viewed the premises and considered the advantages and
disadvantages which will probably be the result of widening
and extending the said street as aforesaid, proceed to value
and assess on oath what damages may be sustained by any person
or persons whatever, by the widening and extending of
Water-street, by the removing the projection of said Cheapside
Hotel beyond the regular line of Water-street, in the square aforesaid,
and shall also declare what sum of money each individual
or company benefitted thereby, shall respectively contribute and
pay towards compensating those whom they judge to be injured
by the widening and extending said street, and the removing
the projection of the building aforesaid, as well as the expenses
attending the same, and the expenses attending the execution of
the power and authority hereby given, and the carrying this
law into full operation: And the said board of commissioners,
or a majority of them, shall return under their hands and seals,
to the register of the city of Baltimore, to be filed and kept ion
his office, and also, to the collector of the city of Baltimore,
one copy to each officer, a list of the names of the person or persons
so benefitted aforesaid, and the amount assessed and charged
to them respectively: And the sums of money so assessed
and charged to each individual or company as aforesaid, shall
be a lien on the property so benefitted. |

3. And be it enacted, That the said
several sums of money
so assessed and charged as aforesaid, shall be collected by the
collector of the city of Baltimore, and shall presently be paid over
by him to the mayor and city council of Baltimore, and by them to
the person or persons entitled to receive the same: And it shall
be
the duty of the collector of the city of Baltimore, within thirty days
from the time of his receiving the list aforesaid to give notice in
one of the newspapers printed in the city of Baltimore, to the persons
respectively bound to pay the same, that the amount so assessed
and charged as aforesaid, must be paid within twenty |
