able to agree with the owner of any land over or upon
which it may be necessary to lay the tracks, and
over, under, or upon which it may be necessary to es-
tablish conductors, conduits, or lines, for the pur-
poses of any such line or lines of electric railway, and
in case the owner or owners as aforesaid,
or any of them shall be "feme covert," under
age, non compos mentis, or under any other
legal disability, or out of said county, the said com-
pany may proceed to condemn and acquire the use of
the same, for the purpose of said electric railway or
railways, or for the purposes of the motive power
thereof; provided, that the right of condemnation
shall not apply to any water power or other property
adjacent thereto and necessary therefor, used in part
or in whole for manufacturing purposes, in the man-
ner provided for by the Code of Public General Laws
of Maryland, Article 23, sections 167 to 169, inclu-
sive, so far as the same may be applicable to said cor-
poration ; and provided further, that before said com-
pany shall lay the tracks for said railways, along any
of the routes that may from time to time be deter-
mined upon by it, that the said company shall file
with the County Commissioners of Baltimore county
a written description of the particular route selected,
and receive from said Commissioners permission to
construct its railway along each route, that may from
time to time be determined upon by said company ;
said company is hereby authorized to enter into agree-
ments with any passenger railway company of the city
of Baltimore for the making of track connections at
the limits of said city, or within Baltimore county
with such city railway, and to make agreements with
such city railway for the carrying of the passengers
of each over the other, and if said city railway, with
which track connections may be made, shall be by
law authorized to use electricity as a motive power,
said company hereby incorporated is hereby author-
ized to enter into agreements with such city railway
for the furnishing of such quantities of electricity or
electric motive power as said city company may desire
or require for the purpose of operating its railway."
