Roland avenue, when opened, or over such property
as the said Railroad Company shall acquire by pur-
chase or condemnation; or at the election of the
Railroad Company it may construct its road from the
intersection of Cedar avenue and Second avenue, wes-
terly along said Second avenue and over such private
property as it may acquire by purchase or condemna-
tion, to Elm avenue; thence northerly on Elm avenue
to Merryman's Lane, and thence by the route above
defined to the property of Richard G. McGill, above
referred to. But the said Railroad Company shall not
extend its line or construct its road on any other pub-
lic road or highway in Baltimore county without the
consent and approval of the Board of County Com-
missioners for Baltimore county being first had and
obtained.
Section 6. And be it enacted, That in all other re-
spects, the powers, rights, duties and obligations of
the said Baltimore, Hampden and Lake Roland Rail-
road Company as now organized and conducting its
corporate business, shall be those contained in its said
charter ; provided, however, that the right is hereby
granted and reserved to the Mayor and City Council
of Baltimore to authorize any other City Passenger
Railway Company, which uses mechanical traction in
the propulsion of its cars, which will grant corres-
ponding right of use to the said Baltimore, Hampden
and Lake Roland Railroad Company to use the
tracks laid by the said Baltimore Hampden and Lake
Roland Railroad Company on any public street or
highway in said city for a distance of not exceeding
seven hundred feet upon the terms and after the pay-
ment by such other company to the said Baltimore,
Hampden and Lake Roland Railroad Company of such
annual sum of money for said use as may be prescribed
and awarded by the arbitration of the Mayor, City
Commissioners, the President of said Baltimore,
Hampden and Lake Roland Railroad Company for the
time being, or a majority of them; provided, however,
that no use shall in any event be made of the tracks
of said Baltimore, Hampden and Lake Roland Rail-
road Company which will interfere with its regular
schedule adopted from time to time for the running of
its cars.
