by the clerk to the mayor and council, and the bond of the


tax collector shall be responsible for the safe keeping by the


said tax collector of said bouds and the proceeds thereof,


the tax collector shall sell said bonds at public auction at


such times, and in such amounts as the mayor and council


shall order, he shall transfer and deliver the same as sold to


the purchaser and receive the money therefor and shall


report under oath to the mayor and council his proceedings,


in the premises with the names, of the persons to whom said


bonds have been transferred, together with the amounts.


received by him from said sales ; said money shall be credited


on the books of the tax collector to the '' Town Improvement


Fund " and paid out by him for the purpose named in sec-


tion 205 A, of this act for which it is received and in the


manner provided ; provided, however, that sections 205 A,


205 B, 205 C, 205 D, and 205 E of this act, and the provisions


of this act shall not be in force and effect, unless the issue


of bonds authorized by an act of Assembly passed at this


present January session of the General Assembly of Mary-


land entitled an act to repeal sections 2ul, 202, 203, 204,


and 205 of article twenty-two of the Code of Public Local


Laws, entitled "Washington County," sub-title "Hagers-


town," and to re-enact the same with amendments, be


adjudged, decided, and declared invalid and illegal by the


Circuit Court for Washington County, or the Court of


Appeals of the State of Maryland, and unless, further, a.


majority of the votes cast at an election held in Hagerstown


on the 28th, day of March, A. D. 1892, shall be cast " For


the drainage and street repair fund."


SEC. 205 B. The mayor and council shall cause to be kept
