SEC. 5. And be it further enacted, That in case the Western


Maryland tidewater railroad company shall deem it necessary to


acquire and use for the purpose of constructing and operating its


railroad, any part of the property of the Northern Central rail-


way company between Maryland avenue and the point where the


railroad of the Western Maryland railroad company connects with


the railroad of the Northern Central railway company in Beuren


street, at or near East Madison street in the city of Baltimore ;


the said Western Maryland tidewater railroad company be and it

of-way only, under the provisions of article twenty-three, of the

limits aforesaid as may be required for the construction thereon


of a double track railroad by said Western Maryland tidewater


railroad company, subject, however, as to the acquisition and use


of that part of the property of said Northern Central railway


company between said limits that may be so taken, to the follow-


ing terms and conditions: first, the said Western Maryland


tidewater railroad company shall not acquire or take in passing


through that part of the property of the Northern Central rail-


way company lying between the east side of Charles street and


the west side of St. Paul street, a greater width of ground be-


longing to said Northern Central railway company than twenty-


six feet, except for the purpose of constructing the walls between


Charles street and St. Paul street, as hereinafter provided, nor a


greater height than will contain the structure hereinafter pro-

vided for; second, the centre line of the ground of the Northern


Central railway company to be taken and used by said Western


Maryland tidewater railroad company between the east side of


Charles street and the west side of Guilford avenue shall, when


prolonged, intersect the centre line of Charles street not more


than ninety and six-tenths feet south of the intersection of the


centre lines of Charles and Lanvale streets, and shall intersect the


centre line of Guilford avenue not more than one hundred and


seventy-nine feet south of the intersection of the centre lines of


Guilford avenue and Federal street, and between its intersection


with the centre lines of Charles street and Guilford avenue; the


centre line of the property of the Northern Central railway com-


pany taken and used by the" Western Maryland tidewater, railroad


company shall be a straight line; third, the said centre line of


the ground to be taken and used by said company shall be con-


tinued in a straight course across the property of the Northern
