construct no part of its road between Centre street and Eastern
|
|
|
|
avenue as a surface road, or cross any street, alley or way at grade
|
|
|
|
south of Centre street or north of Eastern avenue, but said road
|
|
|
|
south of Centre street and north of Eastern avenue shall he con-
|
|
|
|
structed at such an elevation above the surface of any street, alley
|
|
|
|
or way, occupied or crossed, as to give such clearance above the;
|
|
|
|
surface of said street, alley or way, and such approaches to the
|
|
|
|
grade crossings at Centre street and at Eastern avenue, as may
|
|
|
|
be prescribed by the mayor and city council of Baltimore; and
|
|
|
|
said railroad company in constructing that part of its road hereby

required to be an elevated road, may construct so much thereof
|

|
|
as may be necessary above or over Jones' Falls, but only in such
|
|
|
|
manner as may be approved by the mayor and city council of
|
|
|
|
Baltimore, and the whole of the elevated part of said road shall
|
|
|
|
be subject as to the location, elevation and mode of construction
|
|
|
|
thereof to the control and direction of the said mayor and city
|
|
|
|
council; and said company may also construct suitable stations,
|
|
|
|
depots, turnouts and sidings; provided, that any such stations,
|
|
|
|
depots, turnouts or sidings constructed in connection with that
|

part of its road hereby required to be constructed as an elevated
|
|
|
|
road, shall be at such points as may be permitted by the mayor
|
|
|
|
and city council of Baltimore, and shall also be subject in all
|
|
|
|
respects to the provisions herein contained with reference to the
|
|
|
|
main line of said elevated road.
|
|
|
|
SEC. 4. And be it further enacted, That said Western Maryland
|
|
|
|
tidewater railroad company be and it is hereby authorized and
|
|
|
|
empowered to acquire and use a right-of-way twenty-six feet wide
|
|
|
|
through the lands of the Northern Central railway company west
|
|
|
|
of Jones' Falls and north of North avenue; the westernmost line
|

of said right-of-way beginning at a point about one thousand feet
|
way.

|
|
north of North avenue, and not less than one hundred and twenty-
|
|
|
|
two feet east of the centre line of the south bound main track of
|
|
|
|
said Northern Central railway company, andrunning thence south
|
|
|
|
parallel with said centre line of said southbound main track and
|
|
|
|
always not less than one hundred and twenty-two feet east of the
|
|
|
|
same; to intersect the west side of Jones' Falls under North ave-
|
|
|
|
nue bridge, with the right to construct a double track bridge
|
|
|
|
across Jones' Falls at or near each end of the right-of-way above
|
|
|
|
authorized and described, and to acquire and use for that purpose
|
|
|
|
the property of the said Northern Central railway company neces-
|
|
|
|
sary for that purpose, and for the northern approach to the most:
|
|
|
|
northern of said bridges, and with the right after crossing said.
|
|
|
|
Jones' Falls at or near North Avenue bridge, to cross the property
|
|
|
|
of the Northern Central railway company lying on the east side
|
|
|
|
of said Jones' Falls and adjacent thereto, but so that said railroad
|
|
|
|
of said Western Maryland Tidewater railroad company shall not
|
|
|
|
be constructed so as to occupy any ground of said Northern
|
|
|
|
Central railway company lying between Jones' Falls and the stone
|
