construct no part of its road between Centre street and Eastern


avenue as a surface road, or cross any street, alley or way at grade


south of Centre street or north of Eastern avenue, but said road


south of Centre street and north of Eastern avenue shall he con-


structed at such an elevation above the surface of any street, alley


or way, occupied or crossed, as to give such clearance above the;


surface of said street, alley or way, and such approaches to the


grade crossings at Centre street and at Eastern avenue, as may


be prescribed by the mayor and city council of Baltimore; and

respects to the provisions herein contained with reference to the


main line of said elevated road.


SEC. 4. And be it further enacted, That said Western Maryland


tidewater railroad company be and it is hereby authorized and


empowered to acquire and use a right-of-way twenty-six feet wide


through the lands of the Northern Central railway company west


of Jones' Falls and north of North avenue; the westernmost line

Jones' Falls at or near North Avenue bridge, to cross the property


of the Northern Central railway company lying on the east side


of said Jones' Falls and adjacent thereto, but so that said railroad


of said Western Maryland Tidewater railroad company shall not


be constructed so as to occupy any ground of said Northern


Central railway company lying between Jones' Falls and the stone
