CHAPTER 457.


AN ACT to authorize and empower the Mayor and


City Council of Hagerstown to make a contract


with a joint stock water company, hereafter to be


formed, for the supply of water to said town, and


to levy taxes to pay said company according to


the terms of said contract.


WHEREAS the corporation of Hagerstown, as well


as the inhabitants thereof, are inadequately supplied


with water, and with a view to encourage and to aid

ample capital to construct water works, and furnish


such supply of water as may be required by the said


corporation and inhabitants thereof; therefore,


SECTION 1. Be it enacted by the General Assembly


of Maryland, That the Mayor and Council of Ha-


gerstown are hereby authorized and empowered to


enter into and make contracts with a joint stock


water company, to be hereafter formed, binding the


corporate authorities of Hagerstown to pay, annually,


to such joint stock water company, the interest at


the rate of six per centum per annum, provided said


interest shall not exceed the sum of four thousand


dollars, to be paid annually, upon the costs of making

lands, buildings, water rights, rights of way, the

costs of erecting and constructing buildings and


machinery, laying mains and pipes, and erecting


reservoirs and plugs for fire purposes, and the entire


cost of completing water works of sufficient capacity


to supply the demands of all the inhabitants of Ha-


gerstown for domestic and manufacturing purposes,
and for the extinguishment of fire and protection of


property in said corporation ; provided, however,


that said annual payments shall not begin until all


the provisions of this section have been complied


with, and said town supplied with water to the sat-


isfaction of the mayor and council.
