eral way is to be constructed, and provided further,

CHAP. 92.

that the Legislature of this State may at any time

 

hereafter regulate, modify or change the control, use

 

and estate of so much of the said road as shall be con-

 

structed under the authority hereby given, and be sit-

 

uate from Braddocks' run through the gorge of the

 

mountains to the basin on the canal of the Chesapeake

 

and Ohio Canal Company, or to the Baltimore and

 

Ohio Rail Road, at or near Cumberland, in such man-

 

ner as it may deem equitable towards the said compa-

 

ny, and necessary to the accommodation of the public

 

travel, or use of so much of the said rail road.

 

SEC. 6. And be it enacted, That if any of the said

Stock unsubcribed may be sold

six thousand shares of the capital stock of the said

 

company, shall remain unsubscribed until the organi-

 

zation of the said company, then the President and

 

Directors may proceed to dispose of such unsubscribed

 

stock, agreeably to the provisions in the twelfth section

 

of the original act incorporating said company.

 

SEC. 7. And be it enacted, That the company shall

not be entitled to exact or receive any toll or duty, ex-

 

ceeding the rate of one cent a ton per mile, on all goods,

 

merchandize or property of any description whatso-

 

ever, transported on said Rail Road, or any lateral

 

ways which they may construct, and also not exceed-

 

ing two cents per mile for each passenger transported

 

on said road.

 

SEC. 8, And be it enacted, That in addition to the

power vested in the President and Directors in the

 

original act to which this is a supplement, the President

 

and Directors, or a majority of them, shall have power

 

to fix, regulate and determine the rate of speed, at

 

which all persons having or running cars on the said

 

Rail Road or lateral ways, shall pass; Provided, that

 

the rate of speed fixed, regulated or determined on by

 

the President and Directors, be not less than five, nor

 

more than fifteen miles per hour, in case steam power

 

should be used in propelling the cars on said road, and

 

that if animal power he used, the rate of speed shall

 

hot be less than five, nor more than ten miles per hour,

 

in descending from the coal-pits to the canal, nor less

 

than two, nor more than ten miles per hour, in as-
