SEC. 4. And be it enacted, That after the expiration
|

of the six days for which the hooks shall have been
|

first opened, if four thousand shares of the said capital
|

stock shall have been subscribed, or if not as soon
|
 
|
thereafter as the same shall have been subscribed if
|
 
|
within three years after the first opening of the hooks,
|
 
|
the said commissioners or any three of them, shall
|
 
|
give thirty days public notice of the time and place of
|
 
|
holding an election for a President and five Directors
|
 
|
of the said company, and that in said election, stock-
|
 
|
holders may vote in person or by proxy, according to
|
 
|
the number of shares held, to be entitled to one vote
|
 
|
for each share, and the commissioners named in the
|
 
|
original act, or any three or more of them, shall be
|
 
|
judges of the said first election of Directors, and any
|
 
|
stockholder shall be eligible as President or Director,
|
 
|
and the said commissioners shall deliver over the ori-
|
 
|
ginal subscriptions to the President and Directors
|
 
|
immediately after their election.

SEC. 5. And 6e it enacted, That as soon as the Al-
|

legany Coal Mine Rail Road Company shall be organ-
|
 
|
ized, according to the several provisions of the origi-
|
 
|
nal and this supplemental act, the President and Di-
|
 
|
rectors of said company, or a majority of them may
|
 
|
construct and repair a Rail Road, from some such
|
 
|
suitable point as may be determined on by them, on
|
 
|
the Chesapeake and Ohio Canal, or on the Basin,
|
 
|
which may be formed by said Canal company, at or
|
location
|
near the town of Cumberland, to the respective Coal
|
 
|
Mines up the valley of Wills' Creek, to the junction of
|
 
|
Braddocks' run, thence up the valley of Braddocks'
|
 
|
run, with lateral ways to the different coal mines, in
|
 
|
the discretion of the President and Directors, or a

majority of them as may seem most expedient; provid-
|
 
|
ed, that nothing in the original or this supplemental
|
 
|
acts, shall be so construed as to prohibit any individual
|
 
|
or individuals from connecting any lateral way with
|
 
|
the Allegany Coal Mine Rail Road, or any of its
|
 
|
branches where such connection can be made without
|
 
|
injury to the road; provided the President and Direc-
|
 
|
tors do not construct such lateral way or ways, on the
|
 
|
