LAWS OF MARYLAND.

CHAP. 232.

Be it enacted by the General Assembly of Maryland,

Authority granted

That the executors of the late William Wilkins, of the

 

city of Baltimore, the survivor or survivors of them, in

 

all cases whereby the will of the said Wilkins, they

 

the said executors or the survivor or survivors of them,

 

are authorised in their discretion to sell any part of

 

the property of the said testator, he, and they are here-

 

by authorised and empowered as to all such property,

 

either to lease for terms of years, renewable for ever,

 

or sell the same or any part thereof, as in their or his

 

judgment the said executors, or survivor or survivors

 

may deem most beneficial for the parties interested,

 

the said property when leased to be held subject to the

 

trusts of the said will, and the rents to be reserved to

 

the parties and their heirs, to whom the proceeds of

 

sales thereof are devised by paid will; and such leases

 

shall contain all the conditions for distraint and re-en-

 

try, and other conditions usual in leases for terms of

 

years, renewable for ever, of ground in the city of Bal-

timore; Provided however, that before any such leases

 

shall be made, upon application by any of the parties

 

interested, to Baltimore County Court, as a Court of

 

Equity, or to the Court of Chancery, and all the per-

 

sons so interested being parties to the proceeding, the

 

said court shall be satisfied that it will be for the ad-

shall take place, and that the leases as proposed in the

 

particular instance or instances, should be made, and

 

shall by decree authorise the. same to he made accord-

 

ingly.
