CHAP. 62.

                                LAWS OF MARYLAND.

owing to their solemn affirmation not being admitted as a qualification
to serve as jurors; therefore,

of taking an
oath, may serve as
jurors except in
capital cities.
    2.  BE IT ENACTED, by the General Assembly of Maryland, That 
the people called Quakers, those called Nicolites or New Quakers,
those called Menonists, Tunkers, and others, holding it unlawful to
take an oath on any occasion, shall be allowed to make their solemn
affirmation as a qualification as jurors, except in criminal cases
that are capital, and upon petitions for freedom
(a), in the manner
that they have been heretofore allowed to affirm, which affirmation
shall be of the same avail as an oath to all intents and purposes
whatsoever.

Court to be satisfied
that such persons
are conscientiously
scrupulous.
    3.  AND BE IT ENACTED, That before any of the persons aforesaid
shall be admitted as a juror in any court of justice in this
state, the court shall be satisfied, by such testimony that they may
require, that such person is one of those who profess to be conscientiously
scrupulous of taking an oath.

                                          CHAP. LXIII.
An Act to authorise the drawing of a Lottery or Lotteries in Middle-Town,
                in Frederick County.

Persons authorised
to raise money by
lottery.
    1.  BE IT ENACTED, by the General Assembly of Maryland, That
Joseph Swearengen, Henry Stembel, Adam Lawrance, Christopher
Syfert, Thomas Powel, Jacob Alexander, junior, Lewis Creager
and Jonathan Levy, or such of them as shall enter into bond
as herein after required, be and they are hereby authorised to raise
by lottery or lotteries, at any place within this state, a sum not exceeding
two thousand dollars, and sell and dispose of the tickets at
any place within the same, free from any tax.
Before they make
sale of any ticket
to give bond.
    2.  AND BE IT ENACTED, That before any of the persons above
named shall proceed to make sale of any ticket or tickets, they shall
give bond in double the sum to be raised by said lottery or lotteries,
conditioned that they will well and truly apply so much of the
money arising therefrom, within six months after the drawing
thereof, as shall satisfy the fortunate adventurers for prizes drawn
by them, and after deducting the necessary expenses, within two
years thereafter apply the residue for the purpose of purchasing a
lot of ground in Middle-town, and erecting therein a market-house
and seminary of learning.
Bond to be lodged
with clerk of
county.
    3.  AND BE IT ENACTED, That the bond so as aforesaid to be entered
into, be lodged with the clerk of Frederick county court, and
upon the same, or any office copy thereof, suit or suits may be
brought for any breach or noncompliance with the conditions thereof.
