nothing shall be done by the said company to interrupt the navigation
of said river for unmasted boats, more than what may unavoidably
arise from the erecting, repairing or rebuilding, the said bridge;
and the said bridge or bridges, when erected, and the said road
connecting the same, when made, shall be and are hereby declared
a public highway for ever thereafter, subject, however, to the provisions
contained in this act.

CHAP. 111.

    12.  AND BE IT ENACTED, That it shall and may be lawful to
and for the president and directors aforesaid for the time being,
their agents and servants, to enter into and upon the lands near to
where the said bridge is to be built, and take stone, gravel or sand,
necessary for building, repairing or rebuilding, said bridge, first
giving notice thereof to the owner of the land, and doing as little
damage as possible, and repairing any breaches made in enclosures,
and making amends for any damage by agreement, if the parties
can agree, if they cannot agree, or if the proprietors be minors,
femes covert or insane, a jury of disinterested freeholders may be
summoned, at the instance of either party, by the sheriff of the
county where the land lies, to view the said damage, and upon
oath, or affirmation, to value the same, of the meeting of which jury
ten days notice at least shall be given to the opposite party, and so
proved to the satisfaction of the jury, before they proceed to such
valuation, and the same, when made so as aforesaid, shall be final.

    13.  AND BE IT ENACTED, That the said president and directors
may contract for, and hold as aforesaid, a lot or lots of ground on
each side of said river, not exceeding twenty acres, for the purpose
of furnishing at all times a supply of building stone, sand and gravel,
for the use of said bridge.

    14.  AND BE IT ENACTED, That in consideration of the risk and
expense to be incurred by the said company in erecting the said
bridge or bridges, and keeping the same in repair, the said bridge
or bridges, and all the profits of the same, shall be and hereby are
vested in the president and directors aforesaid, and their successors,
to and for the use and benefit of the stockholders aforesaid, in proportion
to their respective shares of stock in the said company, and
the same shall be and remain exempt from any tax or appraisement
whatever.

    15.  AND BE IT ENACTED, That it shall and may be lawful for the
said president and directors for the time being, to demand and receive
tolls at the said bridge not exceeding the following rates,
which tolls shall not be altered oftener than once a year, and those
payable shall not at all times be made public at the said bridge,
to wit:  For every coach, chariot, phæton, stage, or other carriage
of pleasure, drawn by four horses, with four wheels, one dollar
and fifty cents; for the like carriage with two horses, one dollar;
for a wagon with four horses, one dollar; for a wagon with two
horses, seventy-five cents; for a chaise, riding chair, gig, cart, or
other two wheeled carriage, with two horses, sixty-two and one
half cents; for the like carriages, with one horse, fifty cents; for
one horse and rider, twenty-five cents; fr a single horse or mule,
twelve and one half cents; for every foot passenger, six and one
quarter cents; for every head of horned cattle, six and one quarter
cents; for every sheep and hog, three and one-eighth cents; and for
all such carriages drawn by oxen in the whole, or party by horses
