CHANCERY

the chancellor may decree against them as equity and
good conscience require,
    Ca sa's issuing out of the chancery court may be entered
not called, and new writ issue,
    Made of determining in the chancery court as to
the lunacy of persons entitled to be executors or administrators,
    The court of chancery may decree or give directions
in cases where under a will it shall be necessary
for an executor or administrator to retain assets in his
hands for the payment of money at a distant period,
    No part of the real estate of a ward shall be diminished
on account of his maintenance or education,
without the approbation of the chancery court, as
well as the orphans court,
    Nothing in this act to affect the general superintending
power of the chancery court with respect to
trust,
    The payment of legacies may be compelled by a
suit in the chancery court, &c.
    Where a citizen has purchased land, the legal title
whereof is outstanding or in a British subject, or in
the state, on bill being filed, chancellor to decree,
&c.
  Money to be decreed to be paid if any due, and
if nothing due, chancellor to convey,
    The chancellor to execute deeds for lands sold by
the commissioners of confiscated property,
    Where the chancellor is interested in any cause in
chancery, the chief judge of the district in which the
chancery court shall sit to decide, &c.
    In any suit in which the chancellor may have been
counsel, or has given an opinion, the chief judge of 
the third judicial district to decide, &c.
    The chancellor may require the opinion of the said
chief judge on any question of law in any suit in
chancery, &c.
    In all cases depending in the chancery court, respondents
to have all the benefits and advantages given
to complainants by the act of 1806, ch. 53, s. 1,

    In cases where power is given to take bill pro confesso,
&c. decision may be made on testimony taken
between the parties instead of issuing commission,
    Provisions of the act of 1797, ch. 43, in addition to
those given sheriffs, extended to the court of chancery
and county courts as courts of equity,
    Chancery court may decree a sale of the equitable
title to real estates,
  May decree a sale of the real estate to save the
personal, &c.
  May, when sales have been made under a supposed
authority of a will, confirm such sale, &c.
    In cases of lands descending to minors residing out
of the state, on bill filed, courts may issue commission
to have guardians appointed to defend suit, &c.
    Same proceedings to be had as if infant had been
summoned, &c.
    Courts may decree a sale of such lands if it appear
for the benefit of such infants,
    Upon appeals from chancery or county courts as
courts of equity, if it appear that proper parties have
not been made, court of appeals may either reverse
the decree or award a new trial, &c.
    Taxes in chancery to be sent out for collection, &c.
    Decrees and final proceedings in chancery court
unrecorded may be certified, &c. in the same manner
as if such decrees, &c. had been duly recorded, &c.
