CHANCERY |
A commission for any purpose, with
the consent of
parties and approbation of the chancellor, which may
lawfully issue, to be directed to them, with power to
any two,
A power given to bring suits in equity
against the
state as therein mentioned,
Provision made for compelling an answer
from defendants
appearing agreeably to an order limiting a
day therefor, or for proceeding without such answer,
Directions respecting property taken
in execution
on which an injunction has issued,
Where a perpetual injunction is decreed
against
the state, the chancellor may order the treasurer to
cancel the bond,
In all cases of contracts by nonresidents
or parties
not known, or if deed who is heir, &c. if a bill
is
filed to compel a specific performance, the chancellor
without the appearance of the party either takes the
bill pro confesso or issues commission, &c.
and may
decree,
Notice to be given, &c. if an appearance
in 18
months decree to be opened,
Party may appear before decree, &c.
Chancellor may direct the sale of
personal property
of idiots, &c. if it appears beneficial to convert
the
same into money, and to place it at interest,
May order the property of idiots, &c. to
be sold
for their support,
May order the whole property, if it will not
admit
of division, to be sold, and to direct the manner
of the application of the money,
Sales to be notified and confirmed before a
conveyance,
On the death of the lunatic, to whom the money
is to belong,
The chancellor upon application, to
send idiots,
&c. to the hospital,
Shall have power to remove such idiot, &c.
Power of the chancellor to decree
the sale of the
equitable title on giving notice to the person having
the legal title,
A commission to take depositions may
(with the
consent of both parties) issue to one person instead
of four,
Directions for notice and proceedings against
the
other heirs, where the person appears who would
have been heir before the act to direct descents,
Against persons returned non est, and
evading
the sheriff,
Causes set down for hearing, or submitted,
where
there is a solicitor in court, shall not abate by the
death of either party,
Directions for the serving of process
on the attorney
general where a bill is filed against the state,
Respecting injunctions prayed against the state,
The chancellor may, on application
of either party,
in actions in the general court, or on bills in chancery,
require and decree that the parties shall produce
either the original books, &c. or certified copies,
or
being satisfied by oath that the said books or papers
contain evidence pertinent to the issue, and that the
party cannot safely go to trial without them,
The chancellor may, when he has ordered
the production
of books, &c. on failure to produce them, take
the allegations in the bill pro confesso,
Where an injunction is obtained by
executors or
administrators on filing bonds as therein prescribed, |
