INDEX TO THE LAWS.
—In default the governor and council may direct
suits, and may give credit for any money not chargeable
by law,
The act of 1716, ch. 16, as to writs
of fieri facias and
venditioni exponas, repealed,
Sheriffs directed to collect and pay
to the treasurers
the taxes on proceedings in the chancery court,
Damages for injuries to county property
recovered by
the levy courts, and fines, to be paid to the sheriffs,
—The sheriffs to pay them to the levy courts, or
their bonds liable to be put in suit,
Temporary powers to be given to the
orphans courts to receive
the sheriffs bonds,
—Such bonds, and the proceedings of the sheriffs,
confirmed,
—Any two justices of the orphans courts authorised
to take sheriffs bonds in the same manner as those
of the county courts, to be lodged with the county
clerks,
Sheriffs to perform the same offices
and duties in the
county courts then established as before,
—Provisions concerning defaults and returns in the
late courts,
The duty of every sheriff to give information
of every
violation of the act to prevent free negroes from selling
corn, &c. without a licence,
The several sheriffs shall three weeks
previous to
every election, cause public notice to be given by advertisement
set up at the most public places within the
district of the time and place of holding the several
elections, under the penalty therein mentioned,
—They shall deliver to the judges a box for receiving
the ballots, and two separate books for the purpose
of entering the voters names, under the penalty therein
mentioned,
—They shall deliver to the judges of elections warrants
of their appointment within ten days after receiving
the same, under the penalty therein mentioned,
The election of sheriffs to be held on the first
Monday
of October 1806, and on the same day in every
third year thereafter,
—Form of the return,
In case of an election to fill a vacancy
the warrant
shall go to the sheriff of the county, &c.
Sheriffs and their deputies prohibited
from purchasing
in any debt due from a person residing in the
county,
—Unless such purchase or assignment shall be made
for a debt before due,
—Persons sued or warranted by them, or other persons
for their use, may give this act, &c. in evidence
on the general issue,
—Manner of determining the fact on the return of
an execution on a judgment so purchased,
—Not to extend to cases of amerciaments and defaults
under the act of 1768, ch. 10,
—Not to deprive them of the advantages reserved
to them by the act of 1795, ch. 54,
Sheriffs to bring before the court or judge petitioning
debtors, as therein directed,
—Entitled to a preference for fees of imprisonment
after the discharge of all liens,
Executions for fines against constables
for not returning
executions, &c. may be directed to the sheriffs,
Fees accruing to sheriffs, &c.
to be sent out in dollars
and cents, and not otherwise, |
