            INDEX TO THE LAWS.
 

    Money to be levied for the support of R. Wilcoxen,
    A road to be laid out from New-Market to intersect
the George Town road near Griffith's land, and thence
to intersect the old Baltimore and Frederick road near
H. Wayman's.
    So much of the act to provide for the education of
poor children as relates to Montgomery county, (1816,
ch. 244,) repealed,
    Money to be levied for the support of the daughter
of Eleanor Nicholls,
—Same, for the support of Esther Irvin,
—Same, for the support of Edward Godman, &c.
    The collector to collect the money heretofore levied
under the act of 1816, ch. 244, for the education of poor
children, &c. and not yet collected, and pay the same
to the treasurer of the school fund,
—The said treasurer directed, after paying all contracts
for the education of poor children made by
the trustees, to pay the remainder to the levy court,

    Of Charles county—money to be levied for her support,

    To be erected at Baltimore to the memory of
Washington,

    Supplements,

—The lottery thereof exempted from the delay imposed
by the act of 1817, ch. 154, to regulate lotteries,

    Of Anne-Arundel county—money to be levied for
his support,

    And her children, of Cæcil county—Same,

    Of Charles county—Same,

    Of militia pensions, before they become due, not valid,

    All murder which shall be perpetrated by means of
poison, or by lying in wait, or by any kind of wilful,
deliberate, and premeditated killing, or which shall be
committed in the perpetration of, or attempt to perpetrate
any arson, or to burn any barn, tobacco house,
stable, warehouse, or other out-house, not parcel of
any dwelling house, having therein any tobacco, grain,
hay, horses, cattle or goods, wares and merchandise—
rape, sodomy, mayhem, robbery or burglary, shall be
deemed murder of the first degree,
    All other kind of murder shall be deemed murder of
the second degree,
    The jury, if they find the person guilty, to ascertain
the degree in their verdict,
    If the person be convicted by confession, the court
to proceed by examination of witnesses to determine
the degree, and give sentence accordingly,
    Every person liable to be prosecuted for petit treason
shall be indicted, &c. and punished as is directed in
other cases of murder according to the degree,
    Every person convicted of murder in the first degree,
his aiders, &c. to suffer death by hanging,
    Every person convicted of murder in the second degree,
or as accessary thereto, to be sentenced to confinement
