INDEX TO THE LAWS.
to each non commissioned officer and private trooper,
a sword, a belt, and one pistol, on bond by the officer,
Bond to be given by the noncommissioned officer
or trooper,
Uniform of the staff prescribed,
Provision made for the settlement
of claims arising
from the past or future employment of the militia,
Provision made for the payment of those which
had been called into actual service, and of the expenses
incurred,
Companies to be divided into 10 divisions
by lot, for
routine of duty, when ordered into actual service,
The governor and council authorised
to appoint commissaries
and staff officers to the militia called out, and
to issue supplies,
Calls of the militia to be made on
the commanding
officers of divisions, and to be regularly detached by
them,
In case of insurrection or invasion,
or threats thereof,
measures to be taken by the officers for calling out
the militia, &c.
They may be ordered out when any two justices
of the peace shall require and state in writing that
they
have good reason to believe that the peace and quiet
of
the state is likely to be endangered by an insurrection
or opposition to the laws,
Penalty on officers neglecting to give information
of insurrections or invasions,
Power of the commander of a brigade in such
cases, as to supplies, orders, &c. till the orders
of the
commander in chief shall be known,
Detachments of militia not to serve
longer than sixty
days from their arrival at the place of rendezvous, &c.
Any person called to do a tour of
duty authorised to
find a substitute,
To be approved by the commander of the company,
and the form of the engagement prescribed,
When draughts of the militia are called,
notice to be
given by writing delivered or left at the place of
abode,
Penalty on persons refusing or neglecting
to perform
their tours of duty, (or procure a substitute,) unless
prevented by sickness, &c.
No person serving as a substitute
shall thereby be excused
from standing a draught himself,
Commanders of companies instructed
to include
those having performed a tour of duty in the class allotted
to perform the last tour,
Non commissioned officers and privates
to give receipts
for arms; directions for keeping arms in order;
appearing with them at musters, and for their inspection,
Persons removing, or becoming exempt
from militia
duty, to deliver to the officer commanding the company
the public arms in good order,
On their death the commanding officer to take
possession of such arms, &c.
The public arms to be inspected; provision
made for
recovery of them when embezzled, and for punishment
of the offenders,
Penalty on noncommissioned officers
and soldiers
selling and delivering public arms, and on the purchasers,
Satisfaction to be made for arms lost,
Penalty for selling, buying or giving
arms, or fraudulently
carrying them out of the bounds of the regiment, |
