GOVERNOR AND
    COUNCIL

            INDEX TO THE LAWS.
 

—No governor shall be capable of holding any
other office of profit during the time for which he
shall be elected,
—So much of the 32d and 37th articles of the
constitution as are inconsistent with this act, abolished,
    The governor for the time being considered as an
additional inspector of the penitentiary, when he thinks
proper to meet and act as such,
    In cases of fraud in the accounts of the keeper, the
particulars to be reported by the inspectors to the governor,
    The governor directed to issue a proclamation, on
the penitentiary house being ready,
    The governor authorised at his discretion to arm such
portions of the militia as from their particular situation
may be most exposed to invasion of insurrection.
    The several warrants signed by the governor for payment
of the militia, directed to be recorded,
    The sum therein mentioned directed to be paid to his
order for discharging militia claims, to be appropriated
as therein directed,
    The governor authorised to issue a licence in any
case where by the act of Pennsylvania to incorporate a
company for making the road therein mentioned, such
licence might be issued by the governor of that state,
—The governor required to cause a certified copy
of this act to be transmitted to the governor of Pennsylvania,
    Notice to be given to the governor by the Rail Road
Company of Somerset, when a certain part is completed,
and directions given for a view, and licence to fix
toll gates, &c.
    The attorney general and district attornies may be
removed by the governor upon the address of the general
assembly,
    The constitution altered making it the duty of the
governor to nominate, and by and with the advice and
consent of the council, to appoint officers.  See Constitution.

    The governor and council empowered to appoint
persons at the Head of Elk, and near the line, to prevent
any violation of the inspection law, and to seize
any tobacco, carriage, &c. liable to be forfeited,
    The levy courts to recommend inspectors of tobacco
to the governor and council,
—Two of the five, or one of the three, to be appointed
and commissioned,
—Vacancies to be filled from the persons recommended
in cases of death, resignation or removal,
    Directions respecting the removal of inspectors by
the justices; and the transmission of the complaint on
appeal to the governor and council, and the removal or
continuance of such inspectors, and the appointment
of others,
—The attendance of witnesses may be compelled,
    The determination of the justices entered in their
proceedings, respecting the number of ware-houses,
quantity of tobacco, &c. to be transmitted to the governor
and council,
—More inspectors to be thereupon appointed, or
the number reduced,
    The security in the treasurers bond to be approved
by the governor and council,
—Bond, &c. to be required by them when the securities
become invalid,
