            INDEX TO THE LAWS.
 

though it does not appear that the same were made by
such feme coverts on private examination, or out of the
presence or hearing of their husbands, declared valid,
&c.
—Not to affect the decision of any suit then depending,
or any case where judgment had been obtained, or
where a person having executed such defective deed, or
those claiming under him, were then in possession of
the property,
—When it shall appear that there has been surprise,
or mistake, or fraud in obtaining such deed or acknowledgment,
this law shall not operate to make good such 
deed,

    Of Saint Mary's county, annual allowance to for
rents due and received on tobacco in Cole's warehouse,

    Of the militia—the 45th section of the constitution,
which rendered them ineligible as senators, delegates,
or members of the council, repealed,

    Fees on issuing, allowed to justices of the peace,
    The act of 1716, ch. 16, as to writs of fieri facias, &c.
repealed,
    Equitable estates in lands subjected to sale thereon,
    Provision made in case of the death of a sheriff, &c.

    To executors, &c. if acknowledged before any justice
or register of wills, may be recorded by the register,
—A copy under seal to be admitted as evidence,
—If by non-residents, a certificate of the acknowledgment
to be recorded, &c.  See Administrators,
—Provision for such discharge in cases of trustees
appointed by the chancellor or the county courts,

    A fine to be imposed by a justice of the peace on any
witness not attending, not to exceed 20 shillings,
—How to be recovered,
—Return to be made by the county clerks to the
levy courts,
    Fine on persons not then practitioners, practising
medicine, &c. without obtaining a license,
    Fines on commissioners to alter election districts in
certain counties, on failure to perform the duties,
    Fine for exporting tobacco by water, or lading for
exportation, contrary to the act, $500,
—For carrying it out by land, $150,
—The tobacco and waggon, &c. forfeited, but
permission given to export to Washington, in Columbia,
and fines released, except the part of the informer,
    Fine on inspectors of tobacco not entering into bond
as therein directed, $800,
