ELECTIONS

 

            INDEX TO THE LAWS.
 

three persons as judges for each election district resident
therein,
—Such persons, or a majority, (or one, in case of
the non attendance of the other two,) to be judges or
judge of the election until a new appointment,
—To be conservators of the peace during the election,
'till the ballots are counted and certified,
—May commit offenders for breaches of the peace,
as justices might,
—In case of death, resignation, &c. the levy courts
to appoint others at any meeting thereafter,
—The county clerks to record every appointment
and make out warrants,
—The warrants to be delivered within five days to
the sheriffs, and by them, (within ten days,) to the persons
appointed, or left at their last place of abode,
—Penalty on the clerks or sheriffs neglecting the
said duty,
    Penalty on the judges not attending,
    In case neither of the judges, attend for the space of
one hour after the time directed, the justices of the
county then present, or a majority authorised to choose
three persons to be judges,
—Or one justice, if only one is present,
—If none present, the voters may choose three persons
by ballot,
—The persons chosen to be vested with the same
powers as if chosen by the levy courts,
    The judges to appoint two clerks above 21 years of
age, to enter the names of the voters, who forfeit 10
dollars for neglect or refusal,
    Oath or affirmation to be taken by every judge and
clerk, and a certificate, thereof to be annexed to the
polls,
    The election of electors of president and vice-president
of the United States directed to be on the second
Monday of November 1808, and on the same day in every
fourth year thereafter,
    The election of representatives in Congress directed
to be on the first Monday of October 1806, and on the
same day in every fifth year thereafter,
    The election of delegates to the general assembly directed
to be on the first Monday of October, (then
next,) and on the same day in every year thereafter,
    The election of sheriffs directed to be on the first
Monday of October 1806, and on the same day in every
third year thereafter,
    The elections directed to be held in the several districts,
and at the several places established by the act
of 1799, ch. 50, except where altered as therein stated,
    The elections to commence at nine in the morning,
and to continue without adjournment, and be closed at
six in the evening of the same day,
—No ballot to be taken before the hour of nine,
nor after the said hour of six,
    Every voter to deliver the judges a ballot, on
which shall be written or printed the names of the persons
voted for, and the purpose for which the vote is
given,
—The ballots to be deposited in the box by the judges
until the poll be closed,
—Penalty on judges or others unfolding or opening
them with design to discover the names,
—Penalty on voters offering more than one ballot,
with a fraudulent design,
