CHAP. LIV.
An Act to vacate part of Cherry Alley, in the Town of Cumberland,

Preamble. |
WHEREAS it hath been represented to this general
assembly,
that Cherry Alley, from Washington street to Green-street, is
laid out on ground over which it is impracticable to make a passable
way, and in which street is a very deep and useless well, which
is dangerous to the neighbourhood, and doubts are entertained
whether any person has a right to stop up said alley, therefore, |
Alley to be vacated
and sold. |
1. BE IT ENACTED, by the General Assembly
of Maryland, That
Cherry Alley, in the town of Cumberland, from Washington-street
to Green-street, be and the same is hereby vacated, provided
the consent of the owner or owners of lots binding on said alley
be first obtained; and that the chief burgess, and commissioners
of the said town, be and they are hereby authorised and required
to sell ground to the highest bidder, at public sale, for ready
cash, after having given ten days public notice of said sale, and
upon the payment of the purchase money to convey to the purchaser
or purchasers the said land in fee simple. |

proceeds. |
2. AND BE IT ENACTED, That the money arising
from said sale
shall by the chief burgess, and commissioners aforesaid, be applied
to the use of the corporation of the town of Cumberland. |

Trustees allowance. |
BE IT ENACTED, by the General Assembly of Maryland,
That
each of the trustees of the poor of Somerset county for every day
he shall serve in discharge of his duties under the provisions of
the act to which this is a supplement, shall receive the sum of two
dollars, to be levied on the county, and paid to him by the collector. |
