CHAP. 79.

Proviso.

                                LAWS OF MARYLAND.

thereof, in as full and ample a manner as if originally included in
the location thereof; Provided, that it shall not be lawful to impose
upon said lots, or the owner or owners thereof, any corporation
tax or assessment, until the said lots are built upon or improved.

Plot to be returned     5.  AND BE IT ENACTED, That the said commissioners, or a majority
of them, are hereby directed and required, to return a correct
plot and certificate of said lots, streets, lanes and alleys, to
the clerk of Allegany county court, who is hereby authorised and
required to record the same at the expense of the said David
Lynn, among the land records of said county, and keep the original
plot and certificate in his office, a certified copy of the original
or record, or any part thereof, shall always be conclusive evidence
as to the lots, streets, lanes and alleys, of said addition.
Allowance to commissioners.     6.  AND BE IT ENACTED, That the said commissioners and surveyor,
shall be entitled to receive from the said David Lynn, his
heirs or representatives, the sum of one dollar and fifty cents for
each day they are so employed in locating, changing and altering
Flat-street, and also laying off said addition to the town of Cumberland,
and may if necessary, compel payment by an action of
debt, before a single magistrate, in a summary way.
Vacancies, how to
be supplied.
    7.  AND BE IT ENACTED, That if any of the aforesaid commissioners
shall die, refuse, neglect, or be incapable to act, the remaining
commissioner or commissioners shall appoint some other
person or persons in the place of the person or persons who shall
so die, refuse, neglect, or be incapable to act.

                                      CHAP. LXXX.
An Act respecting a Road in Frederick County.  Lib. TH. No. 5, fol.
                                                223.
Road made public.     BE IT ENACTED, by the General Assembly of Maryland, That 
the road lately surveyed, laid out and opened, one perch wide, by
the inhabitants residing in the neighbourhood of Singleton Burger's
grist mill, at their own expense, leading from said mill to intersect
the new main road leading from Masencop's smith-shop to New-Market,
shall be recorded among the records of Frederick county,
and be hereafter deemed and taken to be a public road, and shall
be kept in repair as other public roads in said county are directed
to be.

                                     CHAP. LXXXI.
An Act to authorise a Lottery in Frederick-Town, in Frederick County.

Lottery authorised
—bond to be given.
    1.  BE IT ENACTED, by the General Assembly of Maryland, That 
it shall and may be lawful for Frederick Nusz, Michael Ott,
George Houck, Henry Kelly, John Doll, Henry Getzhandanner,
and George Jacob Houx, or a majority of them, to propose a
scheme or schemes of a lottery for raising a sum of money not
exceeding seven thousand dollars, and to dispose of the tickets
thereof; provided, the said Frederick Nusz, Michael Ott, George
Houck, Henry Kelly, John Doll, Henry Getzhandanner and George
Jacob Houx, or such majority of them as shall undertake to act
under this law, shall, before the sale or disposal of any ticket or
tickets in said lottery, give their bond to the state of Maryland,
in the penalty of twelve thousand dollars, conditioned that they
