less injury to the said landholder, they, or a majority of them, are
hereby authorised and directed to alter and amend the location of
said road, so far as it runs through the land of the said Philip Quinlan,
and a survey and plot thereof, as altered by them, make and
return tot he clerk of Harford county court, to be by him recorded,
which road so altered and laid out by said commissioners, shall be
opened and kept in repair in the same manner that the road laid out
by the commissioners named in the law to which this is a supplement
is directed to be opened and kept in repair.

CHAP. 23.

    2.  AND BE IT ENACTED, That if the said commissioners herein
named, or a majority of them, upon viewing the original location
of said road, shall be of opinion that the said is laid upon the best
ground or where the public will be best served, or that the location
through the land of Philip Quinlan cannot be altered without injury
to the public, that then and in such case the said commissioners shall
certify the same under their hands to the clerk of the county court
aforesaid, and in that case the original location shall be deemed and
taken for the bed of said road, and shall be opened as directed by
the original law.

    3.  AND BE IT ENACTED, That the commissioners herein named
shall have an allowance of two dollars per day, for every day they
shall severally attend in discharge of the duties herein imposed.

                                       CHAP. XXIV.
An Act to lay out and open a Road in Harford County.   Lib. TH. No.
                                          4, fol. 429.

Passed Dec. 22.
    1.  BE IT ENACTED, by the General Assembly of Maryland, That
William Nelson, William Glenn and John Slade, be and they are
hereby appointed commissioners, and they, or a majority of them, 
are hereby authorised to lay out and open a road in Harford county,
not exceeding thirty-three feet in width, to begin at a certain point
to be fixed on by said commissioners, or a majority of them, on the
old York road near John Almony's in said county, thence by John
Wiley's mill on Deer creek, thence by David Shaver's on a direction
towards Thomas Jorden's smith's shop in Pennsylvania, on
the best and straightest direction the nature of the ground will admit
of, and with the smallest possible injury to the individuals over
whose land the said road may pass; and the said commissioners shall
survey, mark and bound, the said road, and a correct plot and certificate
of the same return under their or a majority of their hands
and seals, to the clerk of Harford county court, to be by him recorded;
Provided always, that the said road shall not be made to
pass through the buildings, gardens or orchards, of any person,
without the consent of the owner or owners thereof.

    2.  AND BE IT ENACTED, That the said commissioners, or a majority
of them, shall value and ascertain the damages that may be
sustained by each and every of the persons through whose lands the
said road may pass, taking into consideration the advantages and
disadvantages, (if any,) and return the same to the levy court, together
with the plot and certificate as above directed; and the damages
so ascertained shall be levied and collected as other county
charges are, and shall be paid over to the persons respectively entitled
to receive the same; Provided nevertheless, that no money shall
be levied or assessed for the purposes of paying the damages aforesaid,
