proceed to open the said road.

Proviso.
    3.  AND BE IT ENACTED, That if any person or persons through
whose lands the said road shall pass, or his, her or their guardian,
shall conceive himself, herself or themselves, aggrieved by such
valuation and assessment of damages by the said commissioners
respectively, it shall and may be lawful for any justice of the
peace, on his, her or their application, to issue his warrant under
his hand and seal, directed to any constable of the county, commanding
him to summon twelve disinterested men, qualified by law
to serve as jurors in the county court, to meet upon the premises
on a certain day, of which notice six days at least shall be given
to the party or parties interested; and the said jurors, when so met,
and having each first taken an oath before some justice of the
peace that he will without favour, affection, prejudice or partiality,
assess the damages sustained by the person or persons at whose
request such inquisition shall be taken by reason of opening the
aforesaid road through his, her or their lands, shall thereupon proceed
to assess and value damages accordingly, taking into consideration
the advantages and disadvantages, if any, and such inquisition
and valuation shall be final and conclusive between the
parties respectively; Provided, that nothing herein contained shall
in any manner authorise the said commissioners to lay out or open
the said road through the buildings, gardens or orchards, of any
person or persons, without his, her or their consent.
Commissioners

    4.  AND BE IT ENACTED, That each of the commissioners aforesaid
shall be entitled to receive two dollars per day for each and 
every day he shall be employed under the provisions of this act.

An Act for the relief of Philip German, Junior, of the City of Baltimore.

Provisos.
    1.  BE IT ENACTED, by the General Assembly of Maryland, That
the judges of Baltimore county court, or any one judge thereof, in
court sitting, be and they are hereby authorised and directed, to
order the body of the said Philip German, junior, to be released
from imprisonment in the gaol of Baltimore county, on any execution
process now issued, or which may hereafter issue from Baltimore
county court, on judgments now obtained, or which may
hereafter be obtained, by any creditor of the said Philip German,
junior, whose debts shall have existed prior to the application of
the said Philip German, junior, for the benefit of the act passed in
eighteen hundred and five*, entitled, An act for the relief of sundry
insolvent debtors, and of the several supplements thereto; Provided
always,
that the creditors or any creditor of the said Philip German,
junior, shall have a right to take out a writ or writs of fieri facias, or
of attachment against the goods, chattels, debts, credits, lands or
tenements, of the said Philip German, junior, in the same manner 
as if the body of Philip German, junior, had not been
taken in execution at the suit of such creditor or creditors; And
provided always,
that nothing in this act contained shall be construed
to release the said Philip German, junior, from his liability
to his creditors or any of them.
