WHEREAS it is represented to this general assembly
by the petition
of Joshua Meekins, of Dorchester county, that a part of the
public road leading from Blackwater river to the head of Hungar
river, in said county, is capable of being charged and altered so
as to relieve the said petitioner and a certain Thomas H. Meekins,
a minor, from much of the inconvenience and injury to which they
are subjected by reason of the said road's passing through their
plantations, and at the same time to shorten its distance; that in
the proposed alteration they are the only proprietors whose lands
will be affected; but in consequence of the minority of the said
Thomas H. Meekins, and his incapability to assent, the levy court
of said county have no power to permit the said road to be changed
or altered; for the purpose of giving the said levy court adequate
powers in the premises, |
Preamble. |
1. BE IT ENACTED, by the General Assembly
of Maryland, That
it shall and may be lawful for the levy court of Dorchester county,
in their discretion, upon the application of the said Joshua Meekins,
to permit the said road to be changed and altered, and in all respects
to use and exercise the same discretion, powers and authorities,
in the premises, as if the said minor were of full age, and
did actually assent to the said change and alteration; Provided,
that nothing herein contained shall be so construed as to impose upon
said minor any part of the charge and expense incurred by opening,
clearing and making the said change and alteration in the
road. |

CHAP. XVIII.
An Act to lay out, open and establish, a new Road in Washington

1. BE IT ENACTED, by the General Assembly
of Maryland, That
Denton Jacques, John Brewer, senior, and Jonathan Nesbett, of
Washington county, be and they are hereby appointed commissioners
to survey, lay out and open, a new road twenty-five feet wide,
to commence at the Pennsylvania line in Jacob Lear's field, where
the new road from Mercersburg to that point ends, and to continue
the said road from thence in the nearest and most practicable direction
to Potomac river, having due regard to the interests of the
proprietors of the land through which the said road shall pass;
and that the said commissioners, or a majority of them, shall have
full power to lay out and establish the said road for the distance
aforesaid, as they, or a majority of them, shall have
the same twenty-five feet in width, and return a plot of the same
to the levy court of Washington county, designating and shewing
the said road as by them, or a majority of them, laid out; and the
said commissioners, or a majority of them, shall have full power
and authority to contract with the owner or owners of the land
over which the said road shall pass, (except as is hereinafter provided,)
for any damage which the said owner or owners may sustain;
and if the said commissioners, or a majority of them, cannot
agree with such owner or owners for the damages by him, her or |
